IPage 21 <br />MINE ID # OR PROSPECTING ID # M$3-758 <br />INSPECTION DATE 2/21/97 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This complete inspection was conducted by Wally Erickson from the DMG Durango office, 484 <br />Turner Drive, Building F, Suite: 101, Durango, CO 81301, phone (970) 247-5193. Ms. M.J. <br />Cadgene accompanied the DMG inspector throughout the inspection. Original permit was issued <br />to Montrose County on 1/30/84, for 9.0 acres affected area. On 3/4/94, DMG approved transfer <br />of permit and succession of operator, SO-01, for M.J. Cadgene, dba Redvale Sand & Gravel, as <br />successor operator. DMG files do not indicate additional revisions to the original permit. Cadgene <br />Pit is located on the NE rim of ~Nrights Mesa, approximately 2 miles north of Redvale, in portions <br />of the W 1/2 of the SE 1/4 of the SE 1/4 of Section 29, T46N, R14W, NMPM, Montrose County. <br />DMG holds financial warranty in the amount of $4,000. Operation was active during the time of <br />this inspection. Intermittent snow cover existed at the mine site, ground conditions were muddy. <br />During the inspection, operator requested copy of the current Act and Rules. Please find enclosed, <br />copies of the Colorado Land Reclamation Act for the Extraction of Construction Materials, <br />Construction Materials Rules and Regulations of the Colorado Mined Land Reclamation Board, <br />effective 1/96, and Statement of Basis Specific Statutory Authority and Purpose. Please submit <br />payment for the enclosed Act, Rules and Regulations, in the amount of 58.00. <br />All Rules referenced within this inspection report are taken from the Construction Materials Rules <br />and Regulations of the Colorado Mined Land Reclamation Board, effective 1/96. <br />RECORDS -Confusion exists in the records concerning permitted acreage and configuration of <br />permit boundary. Original permit was approved for 9.0 acres affected area. Annual reports, <br />submitted by the operator for 1995 and 1996, indicate 9.85 acres. Application for SO-01 <br />contained a request for reduction in affected area resulting in a permit area of approximately 7 <br />acres. SO-01 was for succession of operator and is not the appropriate revision process for <br />modification of permit boundary. Should the operator desire to revise the permit boundary and <br />affected acreage from the original 9.0 acres, the operator should submit such request through the <br />Technical Revision or Amendment process described in Rules 1.1(6), 1.1(49), 1.9 and 1 .10. <br />SIGNS & MARKERS - Mine identification sign was posted at the ranch entrance at the intersection <br />of County Road HH (CR HH) and CR 35.00. Mine identification sign displayed the permit number, <br />but did not display the name of the operator or statement that a reclamation permit had been issued <br />by the Mined Land Reclamation Board, as required by Rule 3.1.12(1). Additionally, the sign was <br />posted approximately 1 mile from the actual mine entrance. Apparently, the operator posted the <br />sign at the intersection of CR HH and CR 35.00 to assist in locating the mine site. However, Rule <br />3.1.1211) specifically states that the mine identification sign shall be posted at the mine entrance. <br />Locating the sign at the ranch entrance, suggests that the ranch access road is part of the permit <br />area. Please ensure that sign is posted at mine entrance and displays name of operator, permit <br />number, and a statement that reclamation permit has been issued by the Colorado Mined Land <br />Reclamation Board, in accordance with Rule 3.1.12111. <br />Affected area perimeter markers, required by Rule 3.1.1212), were not observed. Please ensure <br />that perimeter of affected area (permit boundary) is delineated in accordance with Rule 3.1.12121. <br />
