III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />maintained. MCC is reminded that all new facilities, no matter how <br />minor, should be permitted as a minor revision or technical <br />revision to be shown on a map and bond liability estimated. <br />Topsoil <br />Subsoil and topsoil has been placed on the Lone Pine underground <br />development waste pile. Five test holes were dug to verify the <br />depth of topsoil. Four to six inches of topsoil is required to be <br />replaced on the pile. All holes dug verified that the required <br />depth was replaced. Subsoil test pits were not dug. MCC informed <br />me that approximately 4-6 feet of subsoil was replaced. The <br />subsoil material from the staging area was used. The amount used <br />was evident as the elevation of the staging area was about 4-5 feet <br />lower than it was previously. This depth was determined because <br />there is an island of material on the bench where there is a <br />monitoring well located. Please see the enclosed form "Annual Bond <br />Release Compliance Tracking" for more details regarding this <br />investigation. <br />Reveoetation <br />MCC is planning to broadcast seed the water tank site, the Lone <br />Pine development waste pile, and the Lone Pine topsoil pile this <br />fall. <br />Air Resource Protection <br />The berm around the coal stockpile at the 3-stacktube facility has <br />been extended to the west to prevent any coal spillage into an <br />undisturbed area and to reduce the amount of coal dust that is <br />blown onto the outslope of storage pad. MCC is considering <br />enclosing the section of conveyor between the silos and the section <br />across the highway which is already enclosed. <br />Excess Spoil and Development Waste <br />As previously stated, the Lone Pine development waste pile has been <br />covered with subsoil and topsoil. MCC should recall that <br />revegetation is considered a critical construction period by Rule <br />4.09.1(11)(a) and should be inspected by a registered engineer or <br />3 <br />
