III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the (acts or evidence supporting the enforcement action. <br />other qualified person under the direction of a qualified <br />professional engineer. Work is scheduled to begin this week to <br />reclaim the west facing slope of the lower refuse pile. An area <br />adjacent to Sylvester Gulch is being investigated by MCC as a <br />location for a second refuse pile. The preliminary plan calls for <br />2.1 million cubic yard pile. Access to the pile would be at the <br />location where the Sylvester Gulch road and the main haul/access <br />road intersect. Topsoil and subsoil piles would be located on the <br />south side of Highway 133 and would be across from the refuse pile. <br />Vegetation appears to be predominantly oakbrush with a few pockets <br />of cottonwoods where there is most likely a spring. The upper <br />limit of the pile would be at an elevation of 6380. Sylvester <br />Gulch and "Tweety" Gulch would be the west and east boundaries. A <br />sediment pond would be located adjacent to the highway in a wetland <br />area. MCC is currently collecting vegetation and soil baseline <br />information and will drill several holes for a stability analysis. <br />A few of the holes will be completed as piezometers. The majority <br />of the holes lie outside the permit boundary and the drilling of <br />these holes are being processed as a Notice of Intent (NOI). One <br />hole is within the permit boundary and MCC is planning to submit a <br />minor revision to drill the hole. <br />CEJ/007INSP.927 <br />4 <br />
