III. COMMENTS -COMPLIANCE <br /> <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />form "DMG Availability of Records". Mr. Barbe informed me that the <br />Division of Water Resources from Montrose conducted an inspection <br />of FW-1 last week. MCC has not received the report, but when it is <br />received it should be included with the other mine records. MCC <br />should schedule their annual certifications for FW-1, MB-1 and MB- <br />2R before the end of the year. MCC should also take the pictures <br />of the Dry Meadow Reference Area before the end of the month, as <br />required in the permit document. Mr. Barbe stated that MCC would <br />be hiring a contractor to conduct the inspection as required by the <br />SPCC plan. <br />Roads <br />Construction of the buttress above the substation to support the <br />access road has begun. The access road was damaged by a slump <br />which most likely occurred as a result of several water line breaks <br />in the area. Once the buttress is completed, the road and bin wall <br />will be repaired. <br />Hvdrolocxic Balance <br />The water level in MB-5 is at the elevation of the principal <br />spillway. MB-4 appeared to have been recently cleaned. Care <br />should be taken to ensure that sediment removed from the pond does <br />not spill into the emergency spillway. There are some locations <br />where the shotcrete used to line ditches has cracked or a "lip" has <br />been created at the boundary between the soil and the shotcrete, <br />where water could potentially pipe under the shotcrete. The <br />following ditches were noted as requiring repair: the portion of <br />Dl-4 to the south of the topsoil pile, D2-9, and other ditches <br />located near the portals. Ditches and culverts noted as requiring <br />maintenance were: C1-6, D1-3, and D2-2B. A section of the new <br />water line is in D1-4 to the south of the topsoil pile. The water <br />line should be taken out of the ditch to ensure the designed <br />capacity of the ditch is maintained. <br />Support Facilities <br />The surface of the material storage bench has been covered with a <br />"chip/seal" type of surfacing. It appears that this type of <br />surfacing is well suited for inclement weather, will reduce rutting <br />of the surface and positive drainage should be more easily <br />2 <br />
