INSPECTION REPORT 5 <br />Initially, the research of the State regs did not turn up the <br />requirement to have coverage so it was noted as a problem during the <br />closeout for the inspection that may have required the change of State <br />regulations to include the requirement to have the coverage. Later <br />review of the same regs turned up the requirement so I contacted Mr. <br />Berry and discussed the need for the change in the operators <br />certificate. He said that he would check with the operator and get back <br />to me as to how it would be handled. The updated certificate with the <br />inclusion of blasting coverage was faxed to me, March 6, 1992. <br />Fourth quarter pond inspections done by company officials were dated <br />December 11, 1991. <br />The last annual report for sediment ponds was posted May 22, 1991. <br />The last MSHA required inspection by a registered professional engineer <br />of the Ccyote Dam was posted, February.20, 1992. _. <br />Blasting records for partings shots were reviewed for the month of <br />February 1989 and overburden shots for the month of January of 1992. No <br />problems were noted. <br />Preblast surveys were done for three different entities within one half <br />mile of blasting. <br />Their annual blasting notification was posted one day after the <br />preceeding one expired. The question was raised about whether they <br />could blast in the interim, the answer was no. Blasting could resume <br />March 2, 1992. <br />Copies of recent minor revisions checked for approval, All were <br />approved with the exception of one that had to be posted in the <br />newspaper following MLRD approval. <br />NPDES discharge records were available for the quarters preceeding the <br />one that the operator is now in. A number of discharge exceedances were <br />noted, procedures for notification of those discharge violations were <br />verified in the correspondence to the permitting agency which is <br />required by permit. <br />The as built certifications for sediment pond construction were posted <br />as noted; <br />West Pyeatt #1 8\5\91, East Pyeatt #1 10\26\88, East Pyeatt #2 <br />10\26\88, Elk Dam #1 10\16\87, West Buzzard #1 10\16\87, West Buzzard <br />#2 10\16\87, West Buzzard #3 10\16\87, No Name #5 10\16\87, Johnson <br />Dam #7R 10\16\87, Johnson #8 10\16\87, Ute #1 10\16\87, East <br />Buzzard #1 10\16\87, East Buzzard #2 10\16\87, Middle Pyeatt #' s <br />1,2,3 11\16\86, Johnson #'s 7 & 10 1\23\86, Pond "H" 9\17\85, Johnson <br />
