111. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />The sediment trap for mine discharge water has been removed from the location beneath the <br />conveyor belt on the Upper Portal Bench. According to MCC, the mine discharge from this point <br />has been rerouted to an energy dissipator elsewhere on the mine site. <br />The discharge pipe installed at Lone Pine Gulch has been completed, an energy dissipator and <br />riprap have been installed in Lone Pine Gulch. The Division is currently reviewing a Technical <br />Revision for a sedimentation pond for treating the dischazge from the Lone Pine pipeline if <br />needed for meeting NPDES discharge limitations. <br />All site ponds were full or contained some water at the time of the inspection, but none were <br />discharging. <br />It was noted during the inspection that sediment control ditch north of the Lower Refuse Pile <br />contained sediment and debris and should be cleaned out. Also, please remove the coal material <br />from the ditch located north of the Breaker Building. <br />The silt fence on the northwest side of the ROM coal pad has broken down in one area and needs <br />repair. Some silt/sediment has begun to runoff from the slope below the ROM coal pad in this <br />area. To ensure continued compliance, please repair the silt fence. <br />Four new temporary stream crossings have been built across the Sylvester Gulch as access for <br />a geotechnical drilling program. As discussed with Christine Johnston, the locations of the <br />stream crossings will be described and illustrated on a map and forwarded to the Division. Two <br />test pits will be dug as part of the geotechnical program, these locations and amounts of material <br />excavated (including subsoil and topsoil) will be described in the weekly Geotechnical Report <br />for the Sylvester Gulch Facilities Area. <br />import Facilities <br />MCC has requested that the final configuration of the Ventilation Shaft #3 site be submitted as <br />an "As-Built" because they have considered design changes during the initial construction phases <br />of the site. As agreed to between DMG and MCC during the site inspection, please submit a <br />letter to the DMG requesting that the reconfigured Ventilation Shaft #3 Site be submitted as an <br />"As-Built" drawing. Also please discuss any changes to the hydrologic balance, the amount of <br />disturbed area, and total amounts of subsoil and topsoil excavated. This course of action was <br />2 <br />
