III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Mike Boulay of the DMG on August 19, 1997. <br />Christine Johnston of Mountain Coal Company accompanied the DMG during the inspection. <br />Specific issues/recommendations identified during the inspection are discussed below. <br />Availability of Records <br />Please update the records file with the following documents: <br />• Latest Findings Document from (Permit Revision No. 7); <br />• The Bond Document is contained with the records file; however, the bond amount <br />needs to be updated to the current reclamation cost estimate value; <br />• 1996 Year-End Subsidence Report; <br />• Rill and Gully Survey through 2nd quarter 1996; <br />• Historic Records Study Area 1996 Report to Vegetation Monitoring Data; <br />• Stream Buffer Zone Maps (from Technical Revision No. 79 and Permit Revision <br />No. 07); <br />• Most current DMG Inspection Reports; <br />• Latest Reclamation Cost Estimate; and <br />• Most current NPDES DMRs. <br />Hydrolo¢ic Balance <br />The light-use road located east of the main HauUAccess Road in Sylvester Gulch where berm <br />materials damaged and broke through the silt fence impacting a portion of Sylvester Gulch was <br />inspected. It was noted that the berm material has been pulled back and/or removed from the <br />azea along Sylvester Gulch where the berm construction materials had entered the stream. The <br />silt fence has been reconstructed along this stretch of the stream. The light-use road is in the <br />process of being reclaimed, and according to MCC personnel is no longer used. It was noted at <br />the time of this inspection that the abatement steps set forth in Notice of Violation No. CV-97- <br />008 have been complied with, with the following exception. Abatement measures to recover <br />topsoil and subsoil that the berm materials were placed directly on top of may not be feasible. <br />However, because the light-use road is being reclaimed and these soil resources were never <br />removed from this portion of Sylvester Gulch, additional abatement will not be required at this <br />time. <br />
