III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />facilitate regrading this area. The subsoil will be placed onto <br />this same slope once the regrading is completed. All topsoil has <br />been stripped for the Lone Pine fan construction. The pile is <br />signed and silt fence has been installed around the base of the <br />pile. MCC plans to seed the pile this fall. Topsoil has been <br />stripped from the pad for the water tank construction. It is also <br />signed and will be seeded this fall. <br />SUBSIDENCE <br />The first day of the inspection focused on subsidence and <br />subsidence cracks that had been identified by MCC in the last two <br />inspection reports. A subsidence crack was identified in the Lone <br />Pine Gulch area that is in places, approximately five feet across <br />and 30 feet deep. The crack extends about 50 feet. It is located <br />near the section line between sections 17 and 20. The crack is <br />closely located to the 2W1N panel in MCC's F seam, in section 20. <br />It was completely developed and retreat mined in 1990. There is <br />approximately 500=750 feet of overburden in this area. The Bear <br />Mine has mined in section 17 in the C and B seams. The C seam was <br />mined in the SE section of section 17, during early 1989, and is <br />not close to the subsidence crack. Bear is now mining the B seam <br />and in the area of the subsidence crack, the seam was mined at 50 <br />percent extraction in the fall of 1993. The B seam overburden is <br />about 900-1000 feet. Mr. Rold and I estimated the crack to be <br />approximately 2-5 years old. The Division's concern was whether <br />the crack, because of its size, could pose a threat to people, <br />wildlife, or cattle. The crack is in a relatively remote area in <br />Lone Pine Gulch above two rock outcrops. There is also a dense <br />cover of oakbrush, which further limits the accessibility to the <br />site. <br />Mr. Larry Mautz, the landowner in section 20 is constructing a <br />hunting cabin. The cabin will be directly over the area MCC <br />intends to mine during the next 6-12 months. MCC is aware that Mr. <br />Mautz is constructing this cabin and is in the process of <br />determining where exactly the cabin is in relation to the mine <br />workings. Mr. Every thinks the cabin is over the 6th or 7th panel. <br />MCC is currently mining the 5th panel. MCC should review Rule <br />2.05.6(6) and perform a pre-subsidence survey of the cabin. <br />
