III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />stockpile, the coverfill stockpile, the coverfill topsoil stockpile and the pump house. All of the <br />small azea exemptions had straw bales and collection ditches or berms in place. No evidence of <br />gullying and no offsite impacts were observed. <br />Topsoil <br />The operator recently performed maintenance work at the main topsoil stockpile. A diversion <br />ditch was installed in the northwest section of the stockpile, so that runoff from the upgradient <br />haul road outslope would not flow into the topsoil stockpile area. Also, the collection ditch was <br />regraded, with new straw bales installed in the ditch notch. The operator was going to have the <br />main topsoil stockpile seeded and mulched the next day. <br />New straw bales had been placed in the collection ditch notches of [he two topsoil stockpiles near <br />pond B. The collection ditches at the coverfill topsoil stockpile and the gob pile topsoil stockpile <br />were functional as well. There was no gullying at any of the five topsoil stockpiles. Topsoil signs <br />were present at the topsoil stockpiles. <br />Roads <br />The paved haul road from old highway 133 to the portal bench was in excellent condition. <br />Recent paving repairs had been done in a couple of places along the road. The guard rail was in <br />good shape as well. The vegetation was coming up fairly well on the haul road cut and fill slopes, <br />considering the seeding took place in late summer or eazly fall of last year. The first 400 feet of <br />this haul road does not drain to a sediment pond. Therefore, it is part of the special focus <br />inspection. The haul road drainage flows into side ditches and to straw bales. The straw bales are <br />working as altemate sediment control but one bale should be replaced soon. <br />The operator has recently graveled the haul road leading up to the east side of the gob pile. The <br />haul road certification for the gob pile haul road has been submitted and the Division is <br />reviewing it. Two portions of this gob pile haul road do not drain into a sediment pond and, <br />therefore, aze part of the special focus inspection. Again, straw bales aze used as altemate <br />sediment control and are in good shape. <br />
