III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />Pond D was dry. The primary discharge pipe gated valve was closed. The riprap in the <br />emergency spillway was in good shape and the inslopes of the incised pond were stable. <br />Culverts and Ditches <br />There were no problems with most of the culverts at the mine site. The culvert diameters were at <br />or in excess of the design requirement. No erosional problems were observed at any of the <br />culvert outlets. Except for the following exceptions, no culverts were blocked and no problems <br />with culvert inlets were observed. However, coal from the portal bench stockpile slid into ditch <br />D-C5, covering up the outlet of culvert C-C4 and the inlet to culvert C-C5. The operator was able <br />to clean out the two culvert ends and the ditch, as well as place a barrier between the ditch and <br />the coal stockpile. The work was completed by the end of the working day of June 30, 1998, and <br />inspected for compliance on the morning of July 1, 1998. The operator intends to build a more <br />permanent barrier in the neaz future. The Division would like to see this change made very soon <br />as this problem would appear to be a recurring one until something more permanent is done. <br />Also, there were two rocks jutting up at the outlet of culvert DC-10. These rocks should be <br />moved so that the culvert outlet is not restricted. <br />The ditches at the mine site were in good shape. Capacity was more than the design requirement <br />for all ditches. Riprapped channels were in excellent condition. There was a small flow of cleaz <br />water dischazging from the portal bench underdrain that daylights into ditch D-C6. However, <br />there were some ditch mainienance items that need to be taken Gaze of soon. The operator <br />repaired the ditch berm on the west side of the portal bench so that disturbed area runoff will not <br />run down the portal bench outslope. However, straw bales need to be placed at the end of this <br />ditch berm. This ditch berm also could use some touchup work in one place near the west end. <br />Also, straw bales on the east haul road ditch, at the mine site entrance, could use replacing. <br />Finally, a little coal has slid into the west side of the gob pile upland diversion ditch, at one <br />location. The ditch doesn't need maintenance now but this area should be watched in the future. <br />Small Area Exemptions <br />The small azea exemptions (SAES) at the mine site aze located at the entrance to the mine site, <br />the material storage azea along the gob pile haul road, the east portion of the gob pile topsoil <br />
