III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of Minerals <br />and Geology (DMG). Running concurrently with the complete inspection were two Office of <br />Surface Mining (OSM) oversight inspections, both conducted by Henry Austin of the OSM <br />Denver office. The first OSM inspection was a regular oversight inspection. The second was a <br />special focus inspection involving offsite impacts from haul roads. Bill Beaz Jr. represented the <br />operator, Bowie Resources Limited. The weather was hot and dry. <br />Before the oversight inspection began, a matter concerning a field minor revision was taken care <br />of. The operator needed to drill an emergency hole to determine the extent of a high ash parting <br />in the coal seam currently being mined. In addition, monitoring hole DH-13 needed reworking <br />due to the hole closing up. The proposed and existing drill hole locations were visited. It was <br />determined that no additional disturbance would be necessary to perform this work. The operator <br />submitted the necessary information in the field and Minor Revision No. 7 was approved. <br />Siens and Markers <br />Surface disturbance mazkers have been placed at the edges of disturbed areas around the mine <br />site. The mazkers are white PVC poles. Mine ID signs were up at the required locations, and <br />contained the correct information. Blasting notice signs were up at the mine site entrances. All of <br />the topsoil stockpile signs were present as well. <br />Sedimentation Ponds <br />The water level in pond B was about one foot below the primary discharge pipe. The gate valve <br />was closed. The emergency spillway was riprapped. The pond embankment appeared to be <br />stable. The amount of vegetation on top of the embankment was fair but was sparse on the <br />embankment outslope. The operator was going to seed and mulch the face of the pond B <br />embankment the next day. <br />The pond C water level was a few inches below the primary discharge pipe. The gated valve was <br />closed and the emergency spillway riprap was intact. The pond embankment appeared to be <br />stable. There was very little vegetation on the pond embankment but the operator was preparing <br />to seed and mulch the embankment the next day. <br />
