SMC 10/92 page 3 <br />The MLRD permit expires 10/11/93. The CO Dept. of Health water quality permit <br />is CO-0000132 and expires 10/31/96. The MSHA number is 05-00294. The <br />insurance, #CLP 2 108 717, expires 8/1/93. The east yard pond, Hubbard Creek <br />pond, #'s 1-7, 9-12, and pond 14 have construction certifications dated 8/1/84. <br />Pond # 8 was certified 7/15/87. The mine water pond was certified 11/25/91. <br />Annual certifications are not being done on the mine. <br />The site lies within 100' of a cemetery and this was addressed during the permitting <br />phase. The new Sanborn Creek disturbance is within 100' of the ROW for the <br />state road. A letter dated 2/28/91 from the road authority allows this disturbance. <br />The Bear Canyon area has three portals. These portals have temporary seals. <br />The tops of the canopies are still evident. Buildings have been removed, but their <br />concrete pads still remain. The substation has been largely stripped of useable <br />parts and the skeleton remains. All areas have what MLRD calls SAE's; meaning <br />that the runoff does not have to go through a siltation control structure. The <br />approved sediment control measures are vegetation and silt fences. <br />The Hubbard Creek area has two disturbed areas. The lower Hubbard Creek site <br />has two portals with temporary seals. The concrete canopies still remain. There <br />are concrete pads remaining also and a substation skeleton. The runoff from this <br />area drains through a silt fence. SMC will have to do a stream channel <br />reconstruction when the access road to the site is removed. The 8' CMP under <br />the access road that Hubbard Creek drains through is scheduled to be removed. <br />This creek is classified as a perennial stream. The disturbance is within 100' of the <br />creek, but that is addressed in the permit. <br />The upper Hubbard Creek disturbance consists of a graveled pad and a pond. <br />This area may be left graveled at the request of the Forest Service as a parking lot <br />for a trail head. SMC and the Forest Service are still negotiating on this. The <br />disturbed area drains to a sedimentation pond. <br />The main facilities area lies along a rail line and state road at the town of Somerset. <br />For descriptive purposes, the site can be broken down into a few areas. <br />Conveyor and Sanbom Creek portals -All this disturbance has an SAE. <br />The sediment control measures consist of a berm and hay bales. The conveyor <br />comes out of the portal and carries the coal over to the loadout area; it is about <br />4000' long. An access road parallels this conveyor to the portals. Along this road <br />is the mine water discharge pond. Monitoring records show that the discharge has <br />been acceptable. <br />
