<br />(Page 4) <br /> <br />NINE ID f OR PROSPECTING ID ~ M-83-086 <br />INSPECTION DATE 9-28-95 INSPECTOR'S INITIALS GSC <br />The following problems (PB) and/or possible violations (PV) (and suggested corrective <br />actions) were identified during this inspection. The problems should be corrected by the <br />dates given, or they will become possible violations. The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land <br />Reclamation Board. The inspector noted on the previous page should be notified of all <br />corrective actions taken. <br />PROBLEHS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />PV-1 The active pit is approximately 6 acres in size and 12-22-95 <br />concurrent backfilling and reclamation were not being PB or PV PV <br />done pursuant to the approved mine plan. This may be a TOPIC(S) MP,RS <br />possible violation to the approved mining plan in that BG <br />the active pit has exceeded the maximum allowable size <br />of 2.1 acres. <br />Corrective Action: Either backfill the pit to the <br />approved maximum size of 2.1 acres or submit a complete <br />amendment to the permit. This needs to include revised <br />mining and reclamation plane and maps which increase <br />the maximum allowable pit size, provide plane for <br />reclaiming all areas disturbed by the mining operation <br />including the pits and settling ponds and recalculates <br />the financial warranty amount. The backfilling activity <br />or amendment submittal must be completed no later than <br />December 12, 1995. During operations, the operator <br />must resume concurrent backfilling and reclamation <br />until the approved mining and reclamation plane are <br />changed and approved by the Division. <br />PB-1 There are currently no design criteria for the sediment <br />pond in the permit file. <br />Corrective Action: The operator needs to contact the <br />Office of the State Engineer to determine if this ie a <br />jurisdictional dam pursuant to the 'Rules and <br />Regulations for Dam Safety and Dam Construction' and <br />MSHA to determine if this ie an MSHA dam. If it ie not <br />a jurisdictional or MSHA dam, the structure falls <br />within the jurisdiction of the Division of Minerals and <br />Geology as a tailings dam. In that case, the operator <br />will need to submit to the Division and get approved <br />design parameters and construction specifications for <br />the structure and a demonstration of stability both <br />from a flood containment and a slope stability <br />standpoint. The design specifications moat be <br />submitted and approved no later than December 12, 1995. <br />In any case, a reclamation plan needs to be submitted <br />by 12-12-95 for the settling pond structure and <br />submitted as a revision to the permit. <br />PB-2 The approved mining plan allows a maximum disturbance <br />of 23 acres for the settling ponds, roads, processing <br />structures, and storage, working and parking areas. <br />Because the pit and settling pond have been enlarged, <br />the operator will need to submit a map showing all <br />current disturbance and include a calculation of the <br />total disturbance and a revised reclamation cost <br />estimate.
