The following problems (PB) and/or possible violations (PV) (and suggested corrective
actions) were identified during this inspection. The problems should be corrected by the
dates given, or they will become possible violations. The possible violations should be
corrected by the dates given to reduce their severity when considered by the Mined Land
Reclamation Board. The inspector noted on the previous page should be notified of all
corrective actions taken.

PV-1 The active pit is approximately 6 acres in size and 12-22-95
concurrent backfilling and reclamation were not being PB or PV PV

the active pit has exceeded the maximum allowable size
of 2.1 acres.
Corrective Action: Either backfill the pit to the
approved maximum size of 2.1 acres or submit a complete
amendment to the permit. This needs to include revised
mining and reclamation plane and maps which increase
the maximum allowable pit size, provide plane for
reclaiming all areas disturbed by the mining operation
including the pits and settling ponds and recalculates
the financial warranty amount. The backfilling activity
or amendment submittal must be completed no later than
December 12, 1995. During operations, the operator
must resume concurrent backfilling and reclamation
until the approved mining and reclamation plane are
changed and approved by the Division.
PB-1 There are currently no design criteria for the sediment
pond in the permit file.
Corrective Action: The operator needs to contact the
Office of the State Engineer to determine if this ie a
jurisdictional dam pursuant to the 'Rules and
Regulations for Dam Safety and Dam Construction' and
MSHA to determine if this ie an MSHA dam. If it ie not
a jurisdictional or MSHA dam, the structure falls
within the jurisdiction of the Division of Minerals and
Geology as a tailings dam. In that case, the operator
will need to submit to the Division and get approved
design parameters and construction specifications for
the structure and a demonstration of stability both
from a flood containment and a slope stability
standpoint. The design specifications moat be
submitted and approved no later than December 12, 1995.
In any case, a reclamation plan needs to be submitted
by 12-12-95 for the settling pond structure and
submitted as a revision to the permit.
PB-2 The approved mining plan allows a maximum disturbance
of 23 acres for the settling ponds, roads, processing
structures, and storage, working and parking areas.
Because the pit and settling pond have been enlarged,
the operator will need to submit a map showing all
current disturbance and include a calculation of the
total disturbance and a revised reclamation cost
estimate. If the operator will be submitting an
amendment, this needs to be included.
