<br />(Page 3) <br /> <br />NINE ID f OR PROSPECTING ID ~ H-83-084 <br />INSPECTION DATE 9-28-95 INSPECTOR'S INITIALS GSC <br />approved, design parameters and construction specifications for the structure and a <br />demonstration of stability both from a flood containment and a elope stability standpoint. <br />The design specifications must be approved by the Division before any further activity to <br />increase the size of the dam ie resumed. <br />PB-2: The approved mining plan allows a maximum disturbance of 23 acres for the settling <br />ponds, roads, processing structures, and storage, working and parking areas. Because the pit <br />and settling pond have been enlarged, the operator will need to submit a map showing all <br />current disturbance and include a calculation of the total disturbance and a revised <br />reclamation cost estimate. <br />PB-3: Refuse consisting of scrap iron and used equipment was observed in the equipment and <br />machinery storage areas. This needs to be disposed of pursuant to Rule 3.1.5(5). Waste oil <br />stained soil was observed on the ground in the equipment storage areas. This contaminated <br />soil needs to be removed and properly disposed and a copy of the bill of lading or landfill <br />receipt provided the Division. Several fuel storage tanks were also observed in this area <br />with no spill containment berms. All fuel tanks on site must have appropriate spill <br />containment structures. <br />PB-4: A diesel generator, 55 gallon fuel tank, and pump are located adjacent to the Middle <br />Fork of the South Platte River. There is no spill containment structure for the fuel tank <br />and the ground along the bank of the Hiddle Fork has been stained from fuel spillage (see PB- <br />4). The contaminated soil will need to be removed and properly disposed and the fuel tank <br />must be placed in a spill containment structure in order to minimize disturbances to the <br />quality of surface and ground water. Verification moat be submitted to the Division in the <br />form of photographic evidence and a copy of the bill of lading or receipt for the <br />contaminated Boil from an approved landfill. The Division suggests that the fuel tank and <br />generator be moved further back from the river to help minimize the likelihood of a fuel <br />release into the Middle Fork. The citizen complaint mentioned noise ae a problem, however, <br />the operator was informed that the Division has no jurisdiction over such matters. The <br />operator is encouraged to contact the complainant and attempt to resolve the issue if <br />possible. <br />PB-5: In 1987, the U.S. congress amended the Clean Water Act to expressly include storm water <br />discharges from industrial sites ae requiring Clean Water Act controls. In 1990, EPA issued <br />regulations that require specific industrial act iv itiee to obtain permits in order to <br />discharge storm water from their facilities. Active and inactive mining operations where <br />storm water comes into contact with overburden, raw material, intermediate products, <br />byproducts, finished products or waste products located at the mining site are specifically <br />included. The deadline to apply for a storm water permit was October 1, 1992. If a storm <br />water permit for this mine has not yet been obtained, the operator moat make application for <br />such a permit ae soon as possible. If any storm water control structures are required to be <br />constructed at the mine as a result of the storm water permitting process, a revision must <br />then be submitted to this Division to include the operational and reclamation aspects of such <br />structures in the Reclamation Permit. <br />I & E Contact Address <br />NAME Ted Zican <br />OPERATOR Zican Sand and Gravel.
