At the time of the inspection, equipment was
staged at these ponds. TMI was actively cleaning the sediment from the ponds prior to the inspection but due to
rainfall and the moist condition of the area, excavation of the sediment was paused temporarily. TMI should
monitor the drainage above the Middle Flume Pond as it appears to be incised and eroding.

East Middle Flume Pond was holding water. The embankment was stable and vegetated. The primary spillway
was clear and functional.

The Grouse Diversion was observed. No problems were noted, and the ditch appears functional.

No Name Pond No. 5 was holding water & discharging at the time of the inspection. The primary spillway was
clear and functional. The embankment was stable and vegetated.

No Name Pond No. 4 was holding water & discharging at the time of the inspection. The primary spillway was
clear and functional. The embankment was stable and vegetated.

The No Name West Diversion was observed. This ditch is vegetated and stable. Flows from the ditch reach No
Name Pond No. 4

The No Name East Diversion has been reclaimed. It appears this ditch was reclaimed at the time the Ithica (I) Pit
East was reclaimed in 2023. The area is stable and vegetated. A patch of thistle was observed; however, it
appears the thistle had been treated with a herbicide as the body of the plants appeared dead and dry.

GENERAL MINE PLAN COMPLIANCE:
Surface mining was actively occurring in the Lancaster (L) Pit at the time of the inspection. The Baby Doe
dragline was excavating the Q coal seam, and the Molly Brown dragline was also actively mining the M and/or Q
seams. It appears TMI is attempting to maximize coal recovery and falling behind on backfilling the pit area.
This issue will require further evaluation by the Division and TMI to ensure TMI is timely backfilling in
accordance with the approved plan. The backfilling and regrade plan should be updated in accordance with Rule
2.05.4(2)(a) as the M10A series map does not appear to accurately reflect the timing of the pit regrade.

TMI was actively mining in the Nighthawk (N) Pit. A truck and excavator team were excavating and hauling
inter-burden from the pit at the time of the inspection and the highwall miner was active in what appears to be the
NN01 area shown on the M10A series maps.

Jennings (J) Pit West is open, and the Queen Anne dragline was sitting idle at this location.
J Pit East has been stripped of topsoil, but the pit has not been opened.
