I, Jared Ebert with the Colorado Division of Reclamation, Mining and Safety (DRMS or Division) <br />conducted the inspection. Mr. Graham Roberts with TMI accompanied me during the inspection. <br />BACKFILL and GRADING – Rule 4.14 <br />Contemporaneous Reclamation 4.14.1; Approximate Original Contour 4.14.2; Highwall Elimination 4.14.1(2)(f); <br />Steep Slopes 4.14.2, 4.27; Handling of Acid and Toxic Materials 4.14.3; Stabilization of Rills and Gullies 4.14.6: <br />As discussed under the General Mine Plan Compliance section of this report, it appears backfilling of the <br />Lancaster (L) Pit is falling behind the timeframes shown on the M10A series maps approved in the permit <br />application. This will be further evaluated by DRMS. <br />Jennings (J) Pit West is open, and the Queen Anne dragline was sitting idle at this location. According to the <br />M10A series map, this pit is to be backfilled and graded in 2025. Per Rule 4.14.1(1)(c) this pit should be rough <br />backfilled within 180 days following coal removal. If removal of coal is complete in this pit, it should be <br />backfilled this year in accordance with the approved plan. <br /> <br />Ithica (I) Pit Middle has been partially backfilled, an open pit still exists to the west. Mining is complete in this <br />pit, it should be completely backfilled. Pursuant to Rule 4.14.1(1)(c), rough backfilling and grading shall be <br />completed within 180 days following coal removal. As it appears mining is complete in this area, and this is not a <br />dragline dominated pit operation with extended backfill timeframes allowed in accordance with TMI’s operation <br />plan under Section 3 of the permit application, this pit should be backfilled and graded this year. <br />Grants, Conditions and Agreements #8 of TMI’s permit requires TMI to conduct surface coal mining and <br />reclamation operations only as described in the approved application. TMI should update their mining and <br />reclamation plan timetable; specifically, the mining, regrade, topsoil stripping and replacement plan, in accordance <br />with Rule 2.05.4(2)(a). <br /> <br />HYDROLOGIC BALANCE - Rule 4.05
