Sedgwick County Road and Bridge Soil Borrow Area to Gravel Pit Conversion Page 8 <br /> 110(c_) Operation Reclamation Permit July 3, 2025 <br /> 3.0 EXHIBIT C -Mining Plan <br /> See Figure 4 for a Pre-Existing Conditions Map <br /> See Figure 5 for a Post-Mining Conditions Map <br /> 3.1 Background and Description of Prior Soil Removal <br /> In 2023, SCRB applied for and was issued a construction borrow permit by the CDPHE under the <br /> general permit XXXXXXXX,which established the basis for soil removal designated as select fill <br /> for a planned commercial real estate development in the Town of Julesburg. That Permit(Ref.No. <br /> XXXXXXXX) included active soil borrow during the period from August 2023 through <br /> September of 2024, after which the site has remained inactive. Ther permit documentation also <br /> included a separate Stormwater Management Plan, as well as plans for final reclamation and <br /> restoration of the site. In March of 2025, Sedwick County received notification from CDRMS <br /> via complaints for local citizens,that the site may have been operating as an illegal sand and gravel <br /> operation, and therefore subject to CDRMS jurisdiction and regulation. After a formal technical <br /> determination conducted by CDRMS, the site was classified as an illegal mining operation and <br /> SCRB was issued a demand for submittal of proper documentation to either close and reclaim the <br /> site, or to bring it into compliance as a legitimate sand and gravel mining operation. Since AEC <br /> had provided assistance to SCRB during preparation of the Construction Borrow Area Permit and <br /> supporting Surface Water Management Plan,they were directed by SCRB to assemble the required <br /> supporting documentation to bring the site into compliance. In May 2025, Sedwick County <br /> advised AEC that their forward intent was to close and reclaim the site, and to work directly with <br /> CDRMS to provide all the required documentation in a timely manner to avoid potential litigation <br /> and/or financial penalties related to operation of the site outside of the determined boundaries of a <br /> permitted mining operation. In May 2025,AEC was advised by CDRMS that the required protocol <br /> for final reclamation and closure of the site included formal application under a 110c small sand <br /> and gravel mining operation (under 70,000 tons per annum). Since this action is being carried out <br /> after actual mining at the site has occurred, there is little existing information documenting the <br /> day-to-day operations that took place. The information contained in this submittal is intended to <br /> provide a snapshot of the conditions of the site from original to existing conditions based on recent <br /> ground surveys, as well as records of production obtained from SCRB and engineering <br /> assessments of volumetrics supported by ground survey data. <br />
