. <br /> Mr. Joel Renfro <br /> RE: Timnath Connell Pit M-1999-050 <br /> April 29, 2025 <br /> the reclamation seed mix to a fast growing, cover crop grass mix to quickly stabilize soils prior to the <br /> anticipated development. Prior to the 2024 permit amendment, maintenance of the requested release <br /> area was to encourage the native grass growth, so herbicides have not been used and weed control of <br /> the area has been restricted to mowing. Active maintenance and mechanical weed control is still <br /> being performed in the area for perennial weeds (i.e. kochia, Russian thistle). However, significant <br /> growth of noxious weeds has not been observed within the area. <br /> With the approval of Amendment No. 1, annexation of the requested release area by the Town of <br /> Timnath, and the planned development, we believe that the area has been sufficiently reclaimed <br /> and is ready for release from the Timnath Connell Pit permit. A summary of compliance with <br /> Subsections 3.1.5 through 3.1.12 of Section 3.1, Reclamation Performance Standards, <br /> Construction Material Rules and Regulations, is provided below. <br /> 3.1.5 Materials Handling <br /> Backfilling and grading meets reclamation requirements. <br /> • No mining steep slopes or highwalls, drill or auger holes, or adits or shafts were created <br /> or left in the permit area for release. <br /> • Backfill has been adequately compacted for stability and future development and to <br /> prevent leaching of toxic or acid forming materials. However, no refuse, acid-forming, or <br /> toxic producing materials have been mined, produced on the site, or used in the backfill. <br /> • All slopes are 3H:1 V or flatter to stabilize soil and minimize erosion, sediment transport, <br /> and siltation on the affected land and adjacent properties. <br /> • Material from mining that could potentially cause unauthorized releases of pollutants to <br /> the surface drainage system was not mined or disposed of within the proposed area for <br /> release. <br /> • No unauthorized release of pollutants to groundwater occurred from materials mined or <br /> handled within the permit area. <br /> 3.1.6 Water—General Requirements <br /> Disturbances to the prevailing hydrologic balance caused by the proposed area for release were <br /> minimal. <br /> • The operator has complied with applicable Colorado water laws and regulations <br /> governing injury to existing water rights. <br /> • The operator has complied with applicable federal and Colorado water quality laws and <br /> regulations, including statewide water quality standards and site-specific classifications <br /> and standards adopted by the Water Quality Control Commission. <br /> • The operator has complied with all applicable federal and Colorado dredge and fill <br /> requirements. <br /> • No temporary or permanent siltation structures were constructed or left within the <br /> proposed area for release. <br /> • No dams were constructed in conjunction with the Timnath Connell Pit permit. <br /> Page 2 of 4 <br />
