• <br /> C <br /> ue earth <br /> SOLUTIONS <br /> April 29, 2025 <br /> Colorado Department of Natural Resources <br /> Division of Reclamation, Mining and Safety <br /> Attn: Mr. Joel Renfro <br /> 1313 Sherman Street; Room 215 <br /> Denver CO, 80203 <br /> RE: Partial Release Request for Timnath Connell Pit(M-1999-050) <br /> Dear Mr. Renfro: <br /> The following information is being submitted on behalf of our client, Connell Resources, Inc., <br /> for the Timnath Connell Pit (M-1999-050). As you know, the Weitzel Road extension and right- <br /> of-way (ROW) area is currently owned by the Town of Timnath and was previously released from <br /> the Timnath Connell Pit permit boundary. Release of the Weitzel Road extension area effectively <br /> divided the Timnath Connell Pit permit boundary into two parts, the mined and reclaimed area <br /> northeast of the road (29.9 acres) and the active mining area southwest of the road (121.4 acres). This <br /> partial release request includes the 29.9 acres northeast of Weitzel Road. <br /> To facilitate Connell Resource's desire, we have prepared the enclosed "Request for a Partial <br /> Release of Permit Area" form for the Timnath Connell Pit permit. Currently, the permit area is <br /> approximately 151.3 acres, as specified in the 2024 permit amendment. Connell Resources is <br /> requesting a release of 29.9 acres so that after the release, the Timnath Connell Pit permit area <br /> will be approximately 121.4 acres. Although an acreage reduction is desired, no bond reduction is <br /> being requested. <br /> The owner of the property to be released is: <br /> Connell LLC <br /> 7785 Highland Meadows Parkway, Suite 1 <br /> Fort Collins, Colorado 80528 <br /> (970) 223-3151 <br /> The release request area has been annexed by the Town of Timnath and is within the town's Regional <br /> Commercial Zoning District. Being within the town's jurisdiction, code compliance for the property <br /> requires continued weed control and stormwater management prior to, and during, development. As <br /> specified in the 2024 permit amendment, current planning for the property includes residential <br /> development. <br /> Mining and reclamation in the release request area has been completed for more than two years, prior <br /> to the 2024 Timnath Connell Pit Amendment No. 1 (approved by the Division October 1, 2024). <br /> Therefore, as described in the pre-amendment permit, the backfilled site was revegetated with a self- <br /> sustaining, native grass seed mix to stabilize the soils. The 2024 permit amendment changed the <br /> site's final land use to include residential and industrial/commercial development and also changed <br /> Blue Earth Solutions, LLC • P.O.
