Stockpiles will be seeded with <br /> yellow sweet clover to prevent erosion of the piles. <br /> • The operation will use existing roads. <br /> • Avoid soil-disturbing actions during periods of heavy rain or wet soils. Apply travel <br /> restrictions to protect soil and water. <br /> • Use suitable measures to avoid or minimize contamination, inter-aquifer exchange of <br /> water, floodwaters from contaminating the aquifer, and infiltration of surface water. <br /> • Slopes in the areas of drainages will be kept at or shallower than 2H:1 V in accordance <br /> with the Storm Water Discharge Plan. <br /> • No blasting to be conducted during the life of the operation <br /> • Reclamation to occur concurrently with excavation to limit the disturbed areas. <br /> • All head-cuts should be rehabilitated immediately after completion of mining at upper <br /> most end of the sites (see appendix C). <br /> Migratory Birds <br /> • In compliance with the Migratory Bird Treaty Act,vegetation disturbance/removal <br /> should be scheduled outside of the most active bird breeding/nesting season time of May <br /> 15-July 15. If vegetation disturbance/removal must occur during this time period,then a <br /> qualified biologist must survey the area for nests, including ground-nesting species, 7-10 <br /> days prior to commencement of vegetation disturbance/removal actions. The operator <br /> must contact the BLM at least 3 weeks prior to the planned vegetation <br /> disturbance/removal to request a clearance survey to be conducted by the BLM Wildlife <br /> Biologist. If any active nests are found, an appropriately sized buffer area must be <br /> established and maintained until the young birds fledge, as determined by BLM Wildlife <br /> Biologist. As the above dates are a general guideline, any active nests that are observed <br /> outside this range must be avoided as described above. <br /> Cultural Resources <br /> • The project area has been intensively surveyed for cultural resources pursuant to Section <br /> 106 of the National Historic Preservation Act. The project has been designed to avoid <br /> historic properties. The area within the Old Spanish Trail corridor will be recontoured <br /> during reclamation to match its current topography. <br /> • Post-Review Discoveries: Any cultural resource(historic or prehistoric site or object) <br /> encountered by the operator, or any person working on their behalf in connection with <br /> operations, shall be immediately reported to the Authorized Officer. The operator shall <br /> suspend all operations in the immediate area of such discovery until written authorization <br /> to proceed is issued by the Authorized Officer. <br /> Realty <br /> • The original deeded easement granted to the United States has been mined through. The <br /> deed allows for a reroute so Southway will reestablish an alternate route suitable to BLM <br /> in order to public access to BLM surface estate east of the private property. This route <br /> will be surveyed and acquired by the BLM. The new route will remain open through <br /> mining for public access and following reclamation and cannot be destroyed.
