Bureau of Land Management Decision Record <br /> San Luis Valley Field Office DOI-BLM-CO-F030-2024-0005-EA <br /> reroute would be required, the operator must coordinate with BLM. Signage will be <br /> placed strategically to avoid traffic conflicts with the operator and the public. <br /> Vegetation <br /> • Reclamation of vegetation communities shall be completed using appropriate native seed <br /> mixes and planting practices in compliance with BLM and CDRMS permit M1987-012. <br /> Cadastral <br /> • Protection of Survey Corner and Boundary Line Markers: Evidence of the Public <br /> Land Survey System(PLSS) and related Federal property boundaries will be identified <br /> and protected prior to commencement of any ground-disturbing activity. This will be <br /> accomplished by contacting Bureau Land Management(BLM) Cadastral Survey to <br /> coordinate data research, evidence examination, and evaluation, and locating, <br /> referencing, or protecting monuments of the PLSS and related land boundary markers <br /> from destruction. In the event of obliteration or disturbance of the Federal boundary <br /> evidence,the responsible party shall immediately report the incident, in writing,to the <br /> Authorizing Official. BLM Cadastral Survey will determine how the marker is to be <br /> restored. In rehabilitating or replacing the evidence the responsible party will be <br /> instructed to use the services of a Certified Federal Surveyor(CFedS),procurement shall <br /> be per qualification-based selection 4, or reimburse the BLM for costs. All surveying <br /> activities will conform to the Manual of Surveying Instructions (Manual) and appropriate <br /> State laws and regulations. Local surveys will be reviewed by Cadastral Survey before <br /> being finalized or filed in the appropriate State or county office. The responsible party <br /> shall pay for all survey, investigation,penalties,and administrative costs. <br /> In addition to the above Terms and Conditions, prior to contract issuance, <br /> • Southway will provide BLM and DRMS an update to the 2018 Mine and Reclamation <br /> Plan updated to include mining of the 23 acres in T29S R73 W section 31, Lot 1 and Lot <br /> 2. <br /> • Southway will provide to BLM and interim reclamation plan to clarify standards in which <br /> the pit will be left during periods of non-production. <br /> • BLM will conduct a competitive sale in accordance with 43 CFR 3602.40. <br /> 4. COMPLIANCE AND MONITORING <br /> Inspections at the site will occur several times a year to confirm that the above stipulations are <br /> being adhered to and confirm the operation is in compliance with regulations allowing for <br /> disposal of mineral materials as laid out in 43 CFR 3600. Inspections will confirm that the <br /> operation is maintaining resource concerns as outlined above,working within the bounds <br /> proposed disturbance. In addition, BLM will be conducing Production Verification inspections <br /> annually using various methods to confirm onsite material loss. An evaluation of royalties to be <br /> paid to BLM will be conducted periodically. <br /> 3 <br />
