gateroads 12L, 13L, 14L, 15L, 16L, 17L, 18L. A portion of Fish Creek is to be undermined by
longwall panels 12L, 13L, 14L, 15L, and associated gateroads. Routt County Road No. 27 is to
be undermined by longwall panels 13L, 14L, 15L, 16L, and 17L. Coal production is not
approved to increase beyond the previously approved 12,000,000 tons per year with the approval
of PR8.
Permit Revision No. 9 (PR-09)was submitted on August 7, 2012, and proposed to modify the
approved Foidel Creek Mine plan for the Western Mining District(WMD). PR-9 proposed to
add an additional longwall panel, the 11-Left Panel, and to include an extension of the 12-Left
and 13-Left Panels. The additional panel, and panel extensions to the west, would have required
modification of the currently approved Foidel Creek Mine Permit Area boundary, adding
approximately 560 acres to the Mine Permit Area. Due to potentially unstable mining conditions
in the PR-09 area, TC requested to withdraw PR-09. The withdraw request was approved by the
Division on June 12, 2013.
Permit Revision No. 10 (PR-10) submitted on January 8, 2015 and Permit Revision No. 11 (PR-
11), submitted on July 8, 2015, proposed to include development and longwall mining of the
Wolf Creek Coal Seam Reserve. The Permit Revisions addressed mining of five of the initial
panels (9RT, 8RT, 7RT, 6RT and 5RT). The Permit Revisions also included development of an
internal ventilation and utility shaft in the Wolf Creek main entries. PR-10 was approved May 4,
2016 and PR-11 was approved February 25, 2016.
Permit Revision No. 12 (PR-12) submitted on November 19, 2018 originally proposed to include
development and longwall mining of additional coal reserve within the Wolf Creek Coal Seam
associated with a Federal Coal Lease by Application (LBA)to the permit. The LBA is within
the current Foidel Creek Mine Permit Area and includes approximately 640 acres and 4.12
million tons of recoverable coal. A 414.0 acre increase to the permit affected area was proposed,
and addressed mining all or portions of four longwall panels (I-Eastthrough 4-East)within the
Wolf Creek Reserve. PR-12 was withdrawn September 15, 2020.
The majority of this area falls under areas previously mined/affected in the Northern and Eastern
Mining District and will also affect an additional 114 acres not currently mined. This 114 acres is
within the 150 acres previously approved to be affected with PR-11. However with the approval
of PR-10 the total approved affected area will be reduced by 36 acres. A portion of Fish Creek
and Foidel Creek is to be undermined. Routt County Road No.33 is to be undermined. Coal
production is not approved to increase beyond the rate of 12,000,000 tons per year.
Revisions to the Permit
Minor Revisions, Technical Revisions, and Bond Release approvals which have been made to
the Foidel Creek Mine permit since the last renewal (RN-07) are listed below.
Revision No. Description Issuance Liability
Date Change
MR322 MR322 Road Modification and Exhibit 14 10/25/2022 $3,780.00
Correction
MR321 6MN Second Bulk Material Borehole BMBH42 8/5/2022 $16,417.00
Foidel Creek Mine 14 August 4,2023
