Perhaps the EDO through Steve Norris <br /> could also help in discussions with the Forest Service in this <br /> regard as well. I would appreciate it if you would follow up on <br /> this with the EDO as soon as possible. <br /> I have brought this matter up with the Attorney General, as it <br /> seems that Mid-Continent still has on-going obligations at the <br /> site. I have requested that Cheryl Linden investigate whether it <br /> is feasible to request the issuance of a judicial order to Mid- <br /> Continent requiring it or its agents to keep the road open. A copy <br /> of that request is enclosed. <br /> After the road access issue is resolved, we should convene a <br /> meeting between various agencies for the purpose of organizing an <br /> emergency response team. This should be done in conjunction with <br /> letting an emergency maintenance contract (see my November 21, 1994 <br /> memo) . All agencies which could potentially mobilize equipment, <br /> f c:rsonnel and materials in response to an imminent emergency should <br /> be invited to participate. This would include Pitkin, Gunnison and <br /> Garfield Counties, Forest Service, Colorado Department of <br /> Transportation, Office of Surface Mining and the Bureau of Land <br /> Management. The purpose of the meeting would be to formulate a <br /> plan and gain commitments of resources to respond to an emergency <br /> situation at the mine during runoff. Late January would be an <br /> opportune time to convene this meeting.
