I have tried to phone the Colorado Department of Transportation in Carbondale, but thus far have been unable to contact anyone there. As I suggested in my memo of December 6, 1994, I think that we will make more progress with CDOT at the Executive Director level rather than on the Division level. Perhaps the EDO through Steve Norris could also help in discussions with the Forest Service in this regard as well. I would appreciate it if you would follow up on this with the EDO as soon as possible. I have brought this matter up with the Attorney General, as it seems that Mid-Continent still has on-going obligations at the site. I have requested that Cheryl Linden investigate whether it is feasible to request the issuance of a judicial order to Mid- Continent requiring it or its agents to keep the road open. A copy of that request is enclosed. After the road access issue is resolved, we should convene a meeting between various agencies for the purpose of organizing an emergency response team. This should be done in conjunction with letting an emergency maintenance contract (see my November 21, 1994 memo) . All agencies which could potentially mobilize equipment, f c:rsonnel and materials in response to an imminent emergency should be invited to participate. This would include Pitkin, Gunnison and Garfield Counties, Forest Service, Colorado Department of Transportation, Office of Surface Mining and the Bureau of Land Management. The purpose of the meeting would be to formulate a plan and gain commitments of resources to respond to an emergency situation at the mine during runoff. Late January would be an opportune time to convene this meeting. Please let me know what your availability is in late January, and I will set the meeting up if you agree with this concept.
