Due to snow <br /> accumulations, access to the mine will be limited to snow mobiles <br /> and foot without such maintenance occurring. I am concerned that <br /> the inability to access the mine could lead to environmental <br /> degradation during the spring run off, as it may be impossible to <br /> mobilize equipment to the site in response to an emergency should <br /> one occur. Mid-Continent or Pitkin Iron has historically kept the <br /> mine site accessible during the winter months. <br /> The Division has contacted several government agencies in an <br /> attempt to secure snow removal commitments, however we have not yet <br /> had a positive response. I assume that these discussions will be <br /> on going. <br /> I am requesting that you investigate whether it is feasible to <br /> request a judicial order which requires Resources, its agents or <br /> Pitkin Iron to maintain access to the site through the winter <br /> months. Perhaps such an order could be sought during the hearing <br /> on the motion for summary judgement on January 3 , 1995.
