13)In the Floodplain section, text should be added to explain how the northern banks of the <br /> Phase 3 area will be protected during flooding. <br /> The riverbanks will be protected with an inflow/outflow structure that allows flood waters to move <br /> freely between the river and the pit. Details of this structure have been added to Map F-1 as well as <br /> the revised Exhibit G text. <br /> 14) To ensure that the Delta Paving Gravel Pit does not impact the hydrologic balance of the <br /> Gunnison River, the application needs to include a water quality monitoring plan, specifically <br /> for the alluvium. The groundwater monitoring plan should be developed in accordance with <br /> Rule 3.1.7(7)(b) and should include a Quality Assurance Project Plan (QAPP) for the <br /> collection of groundwater samples. The plan should provide mitigation steps if there is an <br /> exceedance at a groundwater or surface water monitoring location. Potential impacts to <br /> quality and/or quantity the nearby domestic wells should also be addressed. A copy of the <br /> Division's Groundwater Monitoring and Protection Technical Bulletin has been included as <br /> an enclosure to this letter for your reference. <br /> Please see the revised Exhibit G which outlines a groundwater quality monitoring plan in <br /> accordance with the Rule 3.1.7(7)(b)that includes a Quality Assurance Project Plan. <br /> 15)In the Surface Water section, provide calculations for the lake storage capacity values in <br /> Table G-2. Also, in Table G-2 explain the values 1000-3000 gpm during mining; explain if <br /> those are anticipated pumping rates or refer to something else. <br /> The lake storage capacity volumes were calculated in CAD from the top of groundwater to the <br /> lowest point of the pond edge. A note has been added below Table G-2 explaining the calculation of <br /> the storage capacity volumes. <br /> The 1000-3000 gpm discharge flow rate provided in Table G-2 is the anticipated pump rate as all <br /> discharges during mining will be controlled by pumping. <br /> 16) The Water Consumption and Source section should include a discussion on water rights, <br /> including any existing Substitute Water Supply Plans or Augmentation Plans associated with <br /> water use at the Delta Paving Gravel Pit. The section should also include the applicant's <br /> future intentions related to such plans. <br /> Please refer to the revised Exhibit G attached with a water rights section describing the water <br /> source and the applicant's plan for obtaining the appropriate water rights prior to increasing their <br /> groundwater exposure. Copies of the Water Court Decrees showing proof of water have been <br /> provided with this letter. <br /> 6.4.8 Exhibit H —Wildlife Information <br /> 17)Please explain an apparent contradiction on page H-1. In the second subsection (Seasonal <br /> Use of the Area), it is noted that bald eagles use the site for winter range. However, text in <br /> the fifth subsection suggests that there is no winter range in the affected area. <br /> That language was included to conform with Delta County Land Use regulations which identifies <br /> concerns for critical habitat, critical winter range, calving areas, or big game migration corridors. <br /> Delta Paving 4 Lewicki&Associates <br /> September 2022 <br />
