The language in the original application is unclear, and was intended to say 'critical winter range'.
The bald eagle presence in the area was identified as winter range, not critical winter range. This
has been updated in the revised Exhibit H provided.
6.4.11 Exhibit K Climate
18) The text states that the client is "tropical."Explain if that is accurate, or if"arid"is a better
classification.
The climate could certainly be considered and rather than tropical. The use of tropical is a result of
the naming mechanism of the climate rather than the climate description. The Koppen Climate
Classification of Delta, CO identifies it as a `Tropical and subtropical steppe climate'. This type of
climate is described as occurring on the periphery of deserts in a low-latitude, semiarid steppe
region. It has a transitional wet-dry climate meaning hot, dry summers and cold, snowy winters.
6.4.12 Exhibit L— Reclamation Costs
19) The Applicant should provide more detail on structures, including details on dimensions and
types of construction.
The structures present at the site are described in Exhibit D under section 3. Mine Facilities and
Operation. This section states that all facilities will be portable, including the mine office, scale, and
scale house. Therefore, no structures will be constructed on site. Details of dimensions are
provided; however, it should have no impact on the reclamation bond calculation as all costs are
accounted for in the portable structure demobilization cost. Approximate structure dimensions are
listed as follows:
Structure Dimensions Construction
Office 40' L x 12' W x 10' H Portable
Scale 701 x 12'W x 2'H Portable
Scale House 351 x 10' W x 10' H Portable
6.4.13 Exhibit M—Other Permit and Licenses
20)Please commit to providing copies of all required and approved permits and licenses to the
Division when available. This should include well permits and documents related to water
rights, such as a Substitute Water Supply Plan.
Grand Junction Pipe & Supply Co. commits to submitting copies of all required permits to the
Division after they have been acquired. This language has also been added to the revised Exhibit
M. Some of these permits have already been obtained, and are provided with this letter.
6.4.19 Exhibit S —Permanent Man-made Structures
21)A structural agreement should be sought for the Broad Ax Ditch.
Delta Paving 5 Lewicki&Associates
September 2022
