1.6 Public Notice <br /> 3) Pursuant to Rule 1.6.2(e), please submit proof of the notice to all owners of record of <br /> surface and mineral rights of the affected land and the owners of record of all land surface <br /> within 200 feet of the boundary of the affected land, including all easement holders located <br /> on the affected land and within 200 feet of the boundary of the affected land. Proof of notice <br /> may be return receipts of a Certified Mailing or by proof of personal service. <br /> Notices to all mineral and neighboring property owners were sent out on June 14, 2022. Please <br /> refer to the attached Certified Mail Receipts and return notices for the proof. <br /> 6.4.3 Exhibit C — Pre-Mining and Mining Plan Maps of Affected Land <br /> 4) On the Current Conditions map (C-1), please add and label the ditch on the west side of the <br /> proposed area, which runs parallel to Highway 65. Indicate if this ditch carries irrigation <br /> return flows or has another function. <br /> Please refer to the revised map C-1 with this ditch identified. This is an unnamed ditch owned by <br /> Grand Junction Concrete Pipe Co (landowner) used for irrigation return flows. <br /> 5) On the Current Conditions map (C-1), please add Mel Frazier as the owner of the Broad Ax <br /> Ditch, per correspondence with the Division of Water Resources. <br /> Please refer to the revised Map C-1 with Richard M. Frazier (Mel Frazier) listed as the structure <br /> owner of the Broad Ax Ditch. <br /> 6) On the Current Conditions map and Mining Plan map (C-2), please add and label the berm <br /> at the south end of the site, as appropriate. <br /> Please refer to the revised C-1 and C-2 maps for those berm locations. <br /> 7) The Regarding the Mining Plan map, explain if the large "settling pond"(reclaimed lake) is <br /> the same as the "sediment pond"mentioned in Detail 3. The Division suggests more <br /> consistent terminology. <br /> The reclaimed lake will be used for sediment settling purposes. Settling pond and sediment pond <br /> were used synonymously in the previously submitted application. However, a revised Map C-2 has <br /> been provided with more consistent terminology. <br /> 6.4.4 Exhibit D—Mining Plan <br /> 8) The text states that water from pits will be pumped to a drainage ditch and then it will flow to <br /> the river. However, the Mining Plan map (C-2) indicates that the water will be pumped to a <br /> sediment pond. Please explain this apparent contradiction. <br /> Please refer to the revised Exhibit D attached to this letter. The language has been clarified stating <br /> that water will be pumped from the active mining pit to the settling pond. Water pumped into the <br /> settling pond will rejoin the Gunnison alluvial aquifer and sediment will settle over time. Any excess <br /> water from the settling pond, which is not common, will be released to the Relief Ditch where it will <br /> Delta Paving 2 Lewicki&Associates <br /> September 2022 <br />
