Kiewit I Fountain Colony Pit September 6, 2022 <br /> approximately 313.9-acre permit area. Under the Reclamation Permit and Plan,the affected land area is <br /> congruent with the permit boundary.See Figure 1,Attachment A. <br /> As originally described, the Fountain Colony Pit site is situated on as an upland mesa with moderate to <br /> steep slopes that extend towards the Fountain Creek floodplain.The deposits of gravel range from a few <br /> feet to as much as 30 or more feet in thickness.The slopes have been kept to a maximum grade of 3H:1V, <br /> with some slopes as low as 4H:1V or 5H:1V to allow for blending between the area and surrounding <br /> topography.The mining plan was originally split into five phases that begin from the north end of the site. <br /> Per Technical Revision#1,the phase order was reversed with Phase I beginning from the south end of the <br /> property and Phase V ending at the north end of the property. Since 2002, Phase III, and Phase IV have <br /> been fully reclaimed, with the majority of Phase I, Phase II, and Phase V reclaimed. Additionally, in 2001, <br /> the Reclamation Permit and Plan was amended to add 1.10 acres to the permit area to incorporate a new <br /> main access road from South Charter Oak Ranch Road.This access road will continue to be used for access <br /> to the mining and reclamation operations, as well as for future development, since it is the only point of <br /> entry to the Project site. An unpaved, two-track interior route that segments off the main access road <br /> provides access to Phase I and Phase II of the mining operation.The eastern half of the route pre-dates <br /> mining,while the remainder of the route was developed over the course of mining operations.This route <br /> will also continue to be used as access to Phase I and Phase II, for future development, and/or for local <br /> ranchers who lease part of the area. <br /> The native vegetation of the site consists of various grasses, localized areas of Yucca, and heavy growths <br /> of shrubs/bushes found along the arroyo bottoms. Per Technical Revision #3, a weed control plan was <br /> implemented in 2018 to control rampant Tamarisk growth at the site and has been effective thus far.The <br /> operation lies above any groundwater, but surface water collects seasonally in stormwater detention <br /> basis.Wildlife is present onsite,with larger mammals occasionally occupying the property. <br /> 3.0 EXHIBITA-LEGAL DESCRIPTION <br /> The revised Legal Description is provided as Exhibit A—Legal Description,Attachment B for the revised <br /> permit and affected area.The legal description reflects a reduction in the permit and affected area by 162 <br /> acres. <br /> 4.0 EXHIBIT E-RECLAMATION PLAN <br /> The original plans for the Site's final land use, as described in the approved Reclamation Plan, involve the <br /> land being reclaimed to support industrial and/or residential development. Given this designated land <br /> use,Technical Revision #4 proposes an exclusion of 162 acres from the Reclamation Permit and Plan for <br /> the proposed end use,which is commercial/industrial development. Figure 1,Attachment A displays the <br /> exclusion area proposed in this Technical Revision. If implemented, Phase III and Phase IV, and those <br /> sections of Phases I and Phase 11, will ultimately be developed for commercial or industrial-related <br /> business, subject to a Conditional Use Permit from the City of Fountain. <br /> Regarding reclamation status, as reported by Kiewit, 137 acres in total have been fully reclaimed <br /> (seeded/reseeded) pursuant to the approved methods and seed mix in the existing Reclamation Plan.As <br /> of 2022, Phase I, Phase 11, and Phase V have been mostly reclaimed, with 4.0 acres of unreclaimed <br /> Technical Revision#4 3 Sespe Consulting, Inc. <br />
