Response: <br /> See item 3.28 <br /> 3.37 Lori Cruser <br /> Pagosa Wilds? 63 Bennett Court, Pagosa Springs <br /> List of one (1) suggestion, one (1) question, and seven (7) objections. <br /> Suggestions: <br /> (1) Suggestion: environmental study of water consumption Thank you for the suggestion. <br /> It has already been done. An environmental study of water availability and water <br /> consumption in the Upper Piedra Basin has been conducted several times by the Colorado <br /> State Engineer for various mining and other projects. That information is being reviewed <br /> by the Division of Water Resources in response to filing for water rights and change in <br /> water rights for the Dancing Winds Ranch, including the proposed mining. See Section <br /> 5.2 and Appendix C. Water in the Upper Piedra is NOT over-appropriated and so is not <br /> under administration: initial contact with DWR indicates that the operation will not create <br /> a shortage of water for downstream or local users. <br /> Questions: <br /> (1)Question: what is the plan for emergency response, snow removal, accidents, and fire? <br /> For trucks blocking or slowing traffic? This is an excellent question: thank you for asking. <br /> The Texers and their people will work closely with Hinsdale County Sheriff and Road <br /> Department, especially the South End Shop Foreman, and with Pagosa Springs-based <br /> and Archuleta County agencies and the US Forest Service to plan for such emergencies <br /> in advance, and to assist and cooperate as needed. <br /> Since operations will be limited in winter, and especially during snow events for safety and <br /> health and product quality reasons, we do not anticipate significant need to remove snow <br /> on the site, and operations will not change snow removal requirements on public roads in <br /> any way. No snow will be removed from the site to public or other lands or roads. <br /> By law (Mine Safety and Health Act (MSHA) and Miners Act), miners are required to be <br /> trained in emergency response and dealing with (as well as preventing) fires and <br /> accidents, including first aid. The mine operator is required to have emergency response <br /> plans. The Texers will continue to coordinate and work with County personnel and <br /> neighbors to respond to emergencies. Inevitably, there are traffic and other accidents, as <br /> presently occurs. Having materials available to better maintain and improve roads reduces <br /> accidents.
