the US (WOTSU) since no dredge or fill is being done nor will any be placed
outside the areas being mined and these areas are not jurisdictional. Nor will
wetlands be impacted as none exist on the site that have not been built during
reclamation. Per the last paragraph the activities at this mine do not impact
WOTUS so MCC has no plans to file for a Jl) at this time.
Office of Archaeology $ Historic Preservation
Thank you for the information and if human remains are found when mining is
taking place the Logan County Sheriff will be contacted. This is not a Federal
undertaking and is on private property so Section 106 does not apply.
Colorado Parks and Wildlife
We thank Officer Allen and his colleagues for taking time to review our permit
application and for his comments.
6.4.4 EXHIBIT D - Mining Plan
3. Page 6, it states that the new area(AM3) will become part of the Plant Site and material
stockpile area in the near future. It was not clear in the application when the new area will be
mined.. In Exhibit G, it states that minor revisions may be necessary to the LWUA permit to
account for the increased water exposure. When will the LWUA permit be updated?
The new area will be stripped and used to stockpile material, park equipment and
trucks as needed once the AM3 is approved. Mining will not begin until the Plant Area
is mined near the very end of the life of the mine. At this time the plan is to
continue to mine the East Lake area from north to south then return to the West
Lake area and mine the southern end. We expect this take from 10 to 15 years to
complete. After that we are not sure which direction mining will take in Lake
Marjorie where the Plant Site is located.
The agreement with LWUA is a flexible commitment from LWUA to supply
augmented water for this mine. It provides for water release based on the number
of acres exposed under the LWUA Augmentation Plan (case #17CW3062) that covers
the mine. The original agreement provided for all of the post 1981 exposed water
plus industrial uses at that time (2016) to 102.5 of-ft absolute and increased the
total commitment to 120 ac-ft conditional McAtee will request the increase prior to
opening 45 total acres of lake area. This may not happen for anther 5 to 10 years
depending on material demand at the mine.
Riverside Pit Adequacy Response-June 17,2022(12:11pm) Page 2
Permit#M-1976-056
