6.4.7 EXHIBIT G - Water Information
4. The last SWSP plan DRMS has on file is from 2007. Is there a more current SWSP?Please
submit a copy of the most recent SWSP.
No, The last SWSP that was needed is the 2007 version since the Riverside Pit is now
covered by the Logan Well Users Association decree and augmentation plan.
5. Is the current SWSP adequate enough to cover the proposed exposed water in AM3 until the
LWUA permit can be revised?
Yes, The current decree allows for 120 acre feet of evaporation loss from 47.64 ac.
of post 1981 water surface exposed. At this time the total lake surface at the
Riverside Pit is 21.54 ac-ft of which 5.70 acres is pre 1981 water and 15.84 aces is
post 1981 water that requires 39.90 ac-ft. Prior to opening more then 45 acres of
post 1981 lake area, LWUA will be asked to add more water to the Augmentation Plan
to cover the evaporative losses from the final lake sizes.
6.4.19 EXHIBIT S- Permanent Man-made Structures
7. Currently, about 850 feet of the Lowline Ditch will border the East Lake within 100 feet. In
this amendment, an additional 925 feet of Lowline Ditch will border Lake Marjorie. On page 9 it
states that the armoring on the east shore of the East Lake will not be extended into Lake
Marjorie to protect the ditch. The reason given was that extensive work has been already done to
protect the Lowline Ditch from the effects of river flooding by the ditch company. It is not clear
from the AM3 application if the work completed is also adequate to protect the ditch from the
effects of mining.
When the City of Sterling sold this area to McAtee they retained a 50 foot wide
strip along the west side of the ditch for access and room to do maintenance on the
ditch if needed. McAtee then planned to have a 25 foot wide top of slope setback
from the property line and another 22 feet of dredge setback where vertical mining
will end. This leave a total of leaving 97 plus feet from the armoring on the inside of
the ditch to the active mining limit.
After reviewing the plan McAtee will commit to adding an additional 925 feet of bank
armoring along the east side of the amendment area following the methods approved
in the Bank Protection Plan on Page 2 under the heading titled "East lake Bank
Armoring' dated 8/20/2019. The Reclamation Plan Map has been revised to show
the armoring to be installed from the south point and extending along the east side
Riverside Pit Adequacy Response-June 17,2022(12:1 1pm) Page 3
Permit#M-1976-056
