Lease C-07519 <br /> TSN, R90W, Wh P.M. Section 6, Lots 8 through 19 inclusive <br /> T6N, R90W, Wh P.M. Section 31, Lots 5 through 20 inclusive <br /> A total of 1,194.2 acres <br /> The L-Pit action would not increase coal production over the life of mine, nor would there be an <br /> increase in the affected or disturbed area beyond what was previously approved. The action does not <br /> propose any additional coal to be added to the permit, nor does it modify any existing Federal coal <br /> leases. Additionally, no increase in the reclamation assurance bond will be required for TR-130. <br /> The OSMRE has determined that proposed TR-130 does not constitute a mining plan modification <br /> requiring approval by the ASLM. The OSMRE based its determination on the criteria described in the <br /> Federal regulations at 30 CFR 746.18(d). The reasons are as follows: <br /> 1. Any change in the mining plan which would affect the conditions of its approval pursuant to <br /> Federal law or regulation other than SMCRA. <br /> TR-130 has been reviewed with respect to applicable Federal laws and regulations, and the <br /> proposed changes would not affect the conditions of the mining plan approval pursuant to Federal <br /> law or regulation other than SMCRA. <br /> 2. Any change which would adversely affect the level of protection afforded any land,facility or place <br /> designated unsuitable for mining. <br /> TR-130 does not include any land, facility, or place designated unsuitable for mining. <br /> 3. Any change in the location or amount of coal to be mined, except where such change is the result <br /> of.- (i)A minor change in the amount of coal actually available for mining from the amount <br /> estimated; or (ii)An incidental boundary change. <br /> TR-130 does not change the location or amount of coal to be mined. <br /> 4. Any change which would extend coal mining and reclamation operations onto leased Federal coal <br /> lands,for the.irst time. <br /> Trapper received ASLM approval for a mining plan modification to Federal Leases C-079641 and <br /> C-07519 on April 29, 2016, and mining has been ongoing in these leases since the approval. The <br /> proposed TR-130 would not extend coal mining and reclamation operations onto leased Federal <br /> coal lands for the first time. <br /> 5. Any change which requires the preparation of an environmental impact statement under the <br /> National Environmental Policy Actor 1969, 42 U.S.C. 4321 et seq. <br /> OSMRE's criteria for those actions normally requiring the preparation of environmental impact <br /> statement(EIS) are described in the Department of Interior's Department Manual Part 516 <br />
