EXHIBIT "A" <br /> Minimum Guidelines for Construction near <br /> Black Hills Energy Natural Gas Operated Pipelines and Facilities <br /> • The Encroaching Party shall, at the request of Black Hills Energy, incorporate Heath ATI "sniffer" Gas Detection Units in the <br /> design of paved areas or"Green Belt" areas of Black Hills Energy's Easement. The units shall be installed per Black Hills <br /> Energy Standard TYP-V-0100-B010 Gas Detection Unit for Pipelines Located Under Asphalt or Concrete Parking. <br /> • Any repair, cost or expense incurred by Black Hills Energy as a result of the Crossing or the Encroaching Party's operations <br /> will be at the sole cost. risk and expense of the Encroaching Party, and the Encroaching Party shall promptly reimburse Black <br /> Hills Energy, <br /> • The depth of cover over Pipelines in Black Hills Energy Easements shall not be reduced nor drainage altered without Black <br /> HMIs Energy's written permission <br /> • Construction of any permanent structure, building(s) or other obstructions within any Black Hills Energy Easement is not <br /> permitted <br /> • Planting of shrubs and trees is not permitted on any Black Hills Energy Easement <br /> • Irrigation equipment i.e. backflow prevent devices. meters, valves, valve boxes etc shall not be located on any Black Hills <br /> Energy Easement. <br /> • Foreign Crossings(gas,water electric and sewer lines)may cross perpendicular to Black Hills Energy's Pipeline,upon written <br /> permission from Black Hills Energy.provided that a minimum of four(4)feet of vertical clearance is maintained between Black <br /> Hills Energy Pipelines) and the foreign line or such additional clearance as may be necessary depending on the <br /> circumstances Constant line elevations must be maintained across Black Hills Energy's entire Easement width,gravity drain <br /> lines are the only exception Foreign Crossings below any Black Hills Energy Pipeline must be evaluated by Black Hills <br /> Energy to determine whether a significant length of the Black Hills Energy Pipeline will be exposed and unsupported during <br /> construction. When installing underground utilities, the last line should be placed beneath all existing lines unless it is <br /> impractical or unreasonable to do so Foreign Crossings above the Black Hills Energy Pipeline with less than four(4)feet of <br /> clearance must be reviewed and separately considered by Black Hills Energy Engineering to evaluate whether or if additional <br /> support may be necessary to prevent settling on top of the Black Hills Energy Pipeline <br /> • A foreign Crossing shall cross Black Hills Energy Pipeline(s)and/or facilities at as near a ninety-degree angle as possible A <br /> foreign Crossing shall not run parallel to Black Hills Energy Pipeline within any Black Hills Energy Easement without written <br /> permission from Black Hills Energy If permitted, a minimum clearance of ten (10')' shall be maintained unless separately <br /> approved in writing by Black Hills Energy Engineering and Operations <br /> • The Encroaching Party is advised that Black Hills Energy maintains cathodic protection on its Pipelines If applicable, the <br /> Encroaching Party must coordinate its cathodic protection system with Black Hills Energy. At the request of Black Hills <br /> Energy. the Encroaching Party shall install (or allow to be installed) cathodic protection test leads at all crossings for the <br /> purposes of monitoring cathodic protection The Black Halls Energy Cathodic Protection ("CP") technician and the <br /> Encroaching Party CP technician shall perform post construction CP interference testing. Interference issues shall be <br /> resolved by mutual agreement between the Encroaching Party and Black Hills Energy. All costs associated with the <br /> correction of cathodic protection problems on any Black Hills Energy Pipeline as a result of a Crossing shall be borne by <br /> and/or reimbursed by the Encroaching Party for a period of one year from date the foreign pipeline is put in service. <br /> • A metallic foreign line shall be coated with a suitable pipe coating for a distance of at least 10 feet on either side of Black Hills <br /> Energy's Pipeline unless otherwise requested by the Black Hills Energy CP Technician. <br /> • AC Electrical lines must be installed in conduit and properly insulated consistent with standard industry and best management <br /> practices. <br /> • PHMSA approved pipeline markers shall be installed so as to indicate the route of the foreign Crossing across the Black Hills <br /> Energy Easement <br /> • No power poles, posts of any kind, light standards, etc. shall be installed on any Black Hills Energy Easement. <br /> Reference.
