EXHIBIT "A" <br /> Minimum Guidelines for Construction near <br /> Black Hills Energy Natural Gas Operated Pipelines and Facilities <br /> Construction <br /> • The Encroaching Party shall be solely responsible for informing its contractors of Black Hills Energy's requirements including <br /> but not limited to the terms of any written encroachment agreement <br /> • The continued integrity of Black Hills Energy's Pipelines and facilities and the safety of all individuals in the area of proposed <br /> work near Black Hills Energy's assets or operations are of the utmost importance Therefore,the Encroaching Party or their <br /> contractor must meet with Black Hills Energy representatives prior to construction to provide and receive notification listings <br /> for appropriate area operations and emergency personnel. Black Hills Energy's on-site representative will require <br /> discontinuation of any work that in Black Hills Energy's opinion, endangers the operations or safety of personnel, Pipelines <br /> or facilities <br /> • The Contractor must expose all Black Hills Energy transmission and distribution Pipelines (using hydraulic excavation or <br /> another method consistent with best management practices)prior to other surface work to determine the exact alignment and <br /> depth of the Pipelines A Black HMIs Energy representative must be present, unless approved in writing in advance. In the <br /> event of parallel pipelines, only one pipeline can be exposed at a time <br /> • Black Hills Energy will not allow Pipelines to remain exposed overnight without consent of Black Hills Energy designated <br /> representative Contractor may be required to backfill Pipelines at the end of each day <br /> • A Black Hills Energy representative shall do all Pipeline locating. A Black Hills Energy representative shall be present for <br /> hydraulic excavation The use of probing rods for Pipeline locating shall be performed by Black Hills Energy representatives <br /> only, to prevent unnecessary damage to the Pipeline coating. <br /> • Notification shall be given to Black Hills Energy at least 72 hours before start of construction A schedule of activities for the <br /> duration of the project must be made available at that time to facilitate the scheduling of Black Hills Energy's work site <br /> representative Any Contractor schedule changes shall be provided to Black Hills Energy immediately <br /> • Heavy equipment will not be allowed to operate directly over Black Hills Energy Pipelines or in the Black Hills Energy <br /> Easement unless separate written approval is obtained from Black Hills Energy Heavy equipment shall only be allowed to <br /> cross Black Hills Energy Pipelines at locations designated by Black Hills Energy and where the Encroaching Party has <br /> installed matting consistent with industry standards and best management practices. The Encroaching Party and its <br /> contractors shall comply with all precautionary measures required by Black Hills Energy to protect its Pipelines When <br /> inclement weather exists, provisions must be made to compensate for soil displacement due to subsidence of tires <br /> Equipment excavating within ten (10) feet of Black Hills Energy Pipelines will have a plate guard installed over the teeth to <br /> protect the Pipeline <br /> • Excavating or grading which might result in erosion or which could render the Black Hills Energy Easement inaccessible shall <br /> not be permitted unless the Encroaching Party agrees to restore the area to its original condition and provide protection to <br /> Black Hills Energy's Pipeline and facilities, as directed by Black Hills Energy <br /> • A Black Hills Energy representative shall be on-site to monitor any construction activities within twenty-five(25)feet of a Black <br /> Hills Energy Pipeline or facility The contractor shall not work within this distance without a Black Hills Energy representative <br /> being on site, unless approved in writing by Black Hills Energy in advance. Only hand excavation shall be permitted within <br /> one (1)foot of Black Hills Energy Pipelines or facilities. <br /> Ripping shall not take place unless the position of the Pipeline is known and in no event within ten (10)feet from Black Hills <br /> Energy Pipeline or facilities <br /> • Temporary support of any exposed Black Hills Energy Pipeline by the Encroaching Party may be necessary or may otherwise <br /> be required by Black Hills Energy's on-site representative. Backfill below the exposed Pipelines and 12"above the Pipelines <br /> shall be replaced with sand or other selected material as may be required by Black Hills Energy's on-site representative and <br /> thoroughly compacted in 12" lifts to 95% of standard proctor dry density minimum or as otherwise required by Black Hills <br /> Energy's on-site representative This is to protect against stresses that maybe caused by the settling of the Pipeline <br /> Reference- O&M Procedure Page 3 of 4 <br /> Distribution local <br /> 10117 <br />
