EXHIBIT "A" Minimum Guidelines for Construction near Black Hills Energy Natural Gas Operated Pipelines and Facilities Name of Encroaching Party: 3rian-e)rUa_ + Sh rtJ,l grucac. ovia.� s o�- We C,W O—V P;�- This list of minimum construction guidelines and requirements for the design and installation of foreign utilities, customer encroachments, roads, or other improvements ("Crossings") on Black Hills Colorado Gas. Inc., d/b/a Black Hills Energy ("Black Hills Energy") dedicated utility easements under Municipal Plats, utility rights-of-way, and/or private easements (collectively, "Easements") are not intended nor does it waive or modify any rights Black Hills Energy may have under existing Easements. Reference existing Easements for additional requirements This list of minimum requirements is applicable for Black Hills Energy s natural gas pipeline and associated pipeline appurtenances ("Pipeline") and natural gas facilities on Easements, Encroachments on fee property owned by Black Hills Energy should be referred to the Black HMIs Energy Land Department. Black Hills Energy makes no representations or warranty, express, implied or statutory with respect to its Easements, Pipelines, or any facilities, including but not limited to condition of its assets or the compatibility or suitability of the Encroaching Party's Crossing or encroachment Furthermore, it is necessary for the Encroaching Party to obtain proper conferrals of rights from the fee owners of or others claiming an interest in,the subject property in order to be legally able to construct any encroachments All operations by the Encroaching Party are at the Encroaching Party's sole cost, risk and expense. The Encroaching Party shall be solely responsible for the design, construction maintenance. and operations of its Crossings or encroachments and shall design and maintain its Crossings in good order and condition and in a workmanlike manner in accordance with industry standards, safe work practices and best management practices Furthermore, the Encroaching Party shall be solely responsible for conducting its operations and activities in accordance with all local, state and federal laws. rules and regulations The Encroaching Party shall, at its expense.expeditiously and effectively, remedy any interference that does occur to Black Hills Energy's Easements. property facilities, or operations or, should no appropriate remedy be found at the Encroaching Party's sole expense remove such Crossing or encroachment and restore the crossing area to good order and condition. Design • Black Hills Energy shall be provided sufficient prior notice of planned activities involving boring excavation, blasting, or any type of construction or crossing on, under.or across any Black Hills Energy Easement to determine potential location,grade or encroachment problems and provide additional requirements for protection of its Pipelines or facilities before any work is to take place • Black Hills Energy shall be provided sufficient prior notice of all permanent or temporary road crossings,or staging areas on, over. or across any Black Hills Energy Easement to determine potential location, grade or encroachment problems and provide additional requirements for protection of its Pipelines or facilities before any work is to take place • The Encroaching entity shall provide Black Hills Energy with a set of engineering drawings and specifications for review as well as a set of final construction drawings showing all aspects, including but not limited to location. alignment, plan and profile, specific details including the centerline of any Black Hills Energy natural gas Pipeline, depth of coverage, grade, and dimensions of the proposed Crossings The encroaching entity shall also provide to Black Hills Energy a set of as-built drawings showing the as-constructed Crossing • Only Crossings shown on drawings reviewed by Black Hills Energy, and if required by Black Hills Energy attached to a fully executed encroachment agreement,may be installed on,over.or across Black Hills Energy Easements. All drawing revisions that effect Crossings proposed to be placed on Black Hills Energy Easements must be provided to Black Hills Energy in writing prior to construction.
