Page 3 <br /> Mr. Peter Hays <br /> February 1s',2022 <br /> 8. The Applicant states the only water used will be for dust suppression at the site. Please provide <br /> the legal source of the water and provide documentation the source is permitted for <br /> miningrndustrial use. Water will be sourced from the United Water and Sanitation's Milliken Reservoir. <br /> The Will Serve Letter is attached. <br /> 9. The Applicant states no groundwater will be exposed during the operation under this permit. <br /> Please commit to remaining at least two(2)feet above the anticipated highest groundwater <br /> elevation and to backfilling groundwater to at least two(2)feet above the groundwater <br /> elevation if encountered by the mining operation. Exhibit C subsection d has been revised to state that, <br /> "No groundwater will be exposed during mining under this permit and excavation will remain at <br /> least two(2)feet above the groundwater elevation. If groundwater is encountered by the mining <br /> operation,the area will be backfilled at least two(2)feet above the groundwater elevation." <br /> 6.3.4 Exhibit D-Reclamation Plan <br /> 10. Please state the thickness of plant growth medium(topsoil)to be replaced if the site is <br /> reclaimed as an infiltration pond pursuant to Rule 6.3.4(1)(i). Exhibit D subsection c has been revised to <br /> state that 12 inches of topsoil will be replaced on the pit side slopes above the infiltration zone and <br /> the disturbed areas outside of the pit. Since overburden is approximately 5 feet thick at the site the <br /> side slopes of the pit will typically be seeded 5 vertical feet down from the crest. <br /> 11. The Applicant makes several references to the disturbed areas above the high water level and <br /> outside of the pond will be reclaimed. The Applicant is not proposing to expose groundwater or <br /> construct a pond for the purposed mine site. Please explain this discrepancies and revised <br /> Exhibit D accordingly. In the event that the mining under this permit is complete prior to approval of <br /> the DRMS 112 permit or the DRMS 112 permit is not approved,the pit will be reclaimed as an <br /> infiltration pond. Water will infiltrate on the pit bottom and on the side slopes where there is sand <br /> and gravel.The overburden at the site is typically sandy silt or silty sand which will not be utilized <br /> as an infiltration zone. The side slopes above the zone used for infiltration(above the sand and <br /> gravel)will have 12 inches of topsoil applied and reseeded with the seed mixture described above. <br /> The language in Exhibit D has been revised to describe this more clearly. <br /> 12. The Applicant submitted a financial warranty in the amount of$75,000.00 with the application. <br /> The Division reviewed and will accept the financial warranty amount for the proposed mining <br /> activities. Any adequacy issues with the financial warranty will be sent by the Division under <br /> separate cover. Acknowledged. <br /> 6.3.5 Exhibit E-Map <br /> 13. Please label the names of owners of record of the surface of the affected area and the land within <br /> two hundred(200)feet of the affected area, identify the owner of the substance to be mined and <br /> the type of structure and owners of record of any permanent or man-made structures within 200 <br /> feet of the affected land pursuant to Rule 6.3.5(2)(b). Exhibit E-1 Map has been updated to include CAW <br /> Equities, L.L.C.as the owner of record of the surface area of the affected land.CAW Equities, L.L.C. <br /> owns all the land within 200 feet of the affected area except the site entrance. Randall Knutson owns <br /> the property across from the entrance and has been included on this map.The owner of the <br /> substance to be mined in Red Tierra Equities, L.L.C.and has been included on the map.All <br /> permanent or man-made structures within 200 feet are included on the map the owners of which are <br /> PDC Energy,Weld County Public Works and DCP Midstream. <br /> 6.3.9 Exhibit I-Proof of Filing with County Clerk <br /> 14. Please provide an affidavit or receipt indicating the date on which the revised application <br />
