Page 4 <br /> Mr. Peter Hays <br /> February 1 s�,2022 <br /> information required to address this letter was placed with the Weld County Clerk and Recorder <br /> for public review,pursuant to Rule 1.6.2(1)(c).The revised application information required to address <br /> this letter was placed with the Weld County Clerk and Recorder by email on February 1gt,2022. <br /> 6.3.12 Exhibit L-Permanent Man-made Structures <br /> Where the mining operation will adversely affect the stability of any significant, valuable and <br /> permanent man-made structure located within two hundred(200)feet of the affected land, the <br /> Applicant shall either: <br /> a.provide a notarized agreement between the Applicant and the person(s)having an <br /> interest in the structure, that the Applicant is to provide compensation for any damage <br /> to the structure;or <br /> b. where such an agreement cannot be reached, the Applicant shall provide an appropriate <br /> engineering evaluation that demonstrates that such structure shall not be damaged by <br /> activities occurring at the mining operation;or <br /> c. where such structure is a utility, the Applicant may supply a notarized letter, on utility <br /> letterhead, from the owner(s)of the utility that the mining and reclamation activities, as <br /> proposed, will have "no negative effect"on their utility. <br /> The Applicant submitted a stability analysis with the application. The Division will require the <br /> Applicant to demonstrate they attempted to obtain notarized structure agreements with all owners <br /> of the structures within 200 feet of the affected area of the proposed mine site pursuant to Rule <br /> 6.4.19 prior to the Division's consideration of a stability analysis. Notarized structure agreements were <br /> sent out on January 251",2022 via USPS certified mail.Copies of the certified mail receipts are <br /> included with this letter. <br /> 15. Please provide the Division with copies of all signed and notarized structure agreements with <br /> the owners of permanent man-made structures within 200 feet the proposed affected area <br /> boundary. No structure agreements have been received as of February 1st,2022. If/when any <br /> structure agreements are returned copies will be sent to DRMS. <br /> Included in this response is: <br /> - A copy of the structure agreement proof of mailings. <br /> - Revised Application Form <br /> - Revised Exhibit A <br /> - Revised Exhibit C Mining Plan <br /> - Revised Exhibit D Reclamation Plan <br /> - Revised Exhibit E Map <br /> - Exhibit I Proof of Filing with County Clerk <br /> Please feel free to contact me with any questions or concerns. <br /> CIVIL RESOURCES, LLC <br />
