tf <br /> of time, at no charge, for any snow or mud conditions which cause such Material removal <br /> to be impossible or impractical. <br /> 6.5 Personal PropertyTaxes. Lessee shall pay when due all taxes levied or assessed <br /> against all personal property placed upon the Property by Lessee during the Lease term. <br /> 6.6 Hazardous Materials. Any use, storage, treatment, disposal or release of hazardous <br /> materials on the Property by Lessee shall be in compliance with all applicable federal and <br /> state laws and regulations. Upon termination of this Lease, Lessee shall remove all <br /> hazardous materials used, stored, treated, disposed of or released by it on the Property <br /> during the lease term. Lessee shall indemnify and hold Lessor harmless for any loss, <br /> liability, cost, expense or claim arising from (1) Lessee's use, generation, storage, release <br /> or disposal of any hazardous materials on the Property and (2) Lessee's violation of any <br /> law relating to environmental conditions in connection with the Property. The Lessee's <br /> obligations under this paragraph shall sun�ive the termination or earlier cancellation of this <br /> Lease. <br /> 7. Lessor's Covenants. <br /> 7.I Title. Lessor covenants that it has good title to the Property and the Materials to be <br /> removed from the Property, and warrant and will defend the title to the Property and <br /> Material. Furthermore, Lessor will indemnify Lessee against any and all claims, demands, <br /> suits, liabilities, damages, losses, costs and expenses (including reasonable attorney's fees) <br /> arising from or related to any lien, encumbrance, restriction, or defect in the title to the <br /> Property and Material. In the event the holder of any lien or encumbrance against the <br /> property commences foreclosure proceedings against the Property, Lessee shall have the <br /> right, but not the obligation, to make any cure or redemption payments to stop the <br /> foreclosure. In such case, all sums paid by Lessee to stop the foreclosure shall be credited <br /> against sums Lessee then owes or may in the future owe to Lessor under Section 3, above. <br /> 7.2 Access. Lessor grants to Lessee all necessary access across the Property which is <br /> necessary to provide Lessee with access for its operations under this Lease. <br /> 7.3 Lessee's Expense Recovery. If, prior to termination hereof, Lessee has incurred <br /> expenses in preparing the Property for future operations, then Lessor shall promptly repay <br /> Lessee for all such expenses incurred unless such termination results from Lessee's breach <br /> or from any of the reasons outlined in Sections 8. 1 through 8.4 hereof. These expenses <br /> shall include all labor and overhead costs of Lessee as well as other expenses. <br /> 7.4 Access for Removal of Lessee's Equipment. In the event of any termination of this <br /> Lease, Lessor shall allow Lessee access to the Property for removal of equipment and <br /> extracted material per Section 7.3. <br /> 7.5 Condemnation. Lessor warrants and represents that it has no knowledge of any <br /> condemnation actions pending or threatened against the Property or any portion thereof. <br /> 4 <br />
