7.6 Real Property Taxes. Lessor is responsible to timely pay all real property taxes <br /> owing for the Property. <br /> 7.7 Indemnity. Lessor shall indemnify, defend and hold Lessee harmless from and <br /> against all claims, demands, suits, liabilities, damages, losses, costs and expenses <br /> (including reasonable attorney fees) which may arise by reason of injury to any person or <br /> damage to any property as a result of any act or omission of Lessor, unless such injury or <br /> damage is caused by an act or omission by Lessee. <br /> 7.8 Water. Lessor agrees that Lessee may use all of Lessor's water and water rights on <br /> the Property as needed by Lessee for operations under this Lease, without limitation. <br /> 7.9 Oil Gas and Other Minerals. Lessor owns the surface rights for the Property, but <br /> does not own the oil, gas, and mineral exploration rights. During the term of this Lease, <br /> Lessor shall not, to the extent that it has any control, lease, authorize, or allow oil, gas or <br /> other mineral exploration or operations which interfere in any manner with Lessee's <br /> operations under this Lease. If any such activities are conducted by the owner of the oil, <br /> gas, and mineral exploration rights and these activities substantially interfere with Lessee's <br /> gravel mining or processing operations, Lessee shall have the option to terminate this <br /> Lease. <br /> 7.10 Limited Mining Rights of Lessors: Lessor, for itself and for Ron and Janice Thiel, <br /> related entities, including but not limited to Iron Mountain Bison Ranch and Jan Thiel, Inc., <br /> or limited Lessor use contracted for by Ron and/or Ron and Janice Thiel may, with this <br /> expressed reservation contained in this Lease, remove sand, gravel and topsoil from the <br /> permitted premises for use on the Lessors' property, provided however, that such removals <br /> shall not interfere with Lessee's operations under this Lease, and Lessee will not be held <br /> responsbile for any costs or damages incurred as a result of Lessor's or of aforesaid <br /> designated representative's removals. In engaging in the limited sand & gravel removal <br /> operations, Lessor agrees that it, as well as its aforesaid designated representatives, will <br /> comply with all applicable mining laws and regulations, will provide its own insurance <br /> covering any damages, personal injuries, loss of life, or any other harm resulting from its <br /> activities and will hold the Lessee harmless from any such harm or loss. <br /> 8. Termination. This Lease shall terminate on the earlier of: <br /> 8.1 One year following the date all commercially salable Material has been removed <br /> and sold; <br /> 8.2 Lessee terminating this Lease by giving Lessor written notice on or before <br /> September 1 of any calendar year stating that Lessee is terminating the Lease as of <br /> December 31 of that calendar year; <br /> 8.3 On January I, 2016, unless extended pursuant to Section 2; <br /> 8.4 Either party terminating this Lease under the default provisions of Section 13,below; <br /> 5 <br />
