<br /> 5.3 Liability Insurance. Within 30 days following the date of this Lease, Lessee shall
<br /> furnish to the Lessor copies of certificates of insurance showing that the Lessee has
<br /> insurance coverage covering Lessee's operations on the premises. Said insurance shall
<br /> provide that Lessor be given notice prior to cancellation of said insurance.
<br /> 6. Lessee's Covenants.
<br /> 6.1 Lessee's Possession/Lessor's Access. Lessee shall have, and it is hereby given and
<br /> granted, the right to enter into and take over immediately the exclusive possession and
<br /> control of the leased premises, subject to the reservations of the Lessor contained herein
<br /> which include, among others Lessor's use for personal access during the term of this
<br /> agreement and any extensions thereof, to remain in possession and control thereof, and to
<br /> sample, test, examine, develop, work, mine, operate, use, manage and control the same,
<br /> including water and water rights appurtenant thereto as the same may be required, and to
<br /> mine, extract and remove from said property sand and gravel, asphalt, and other salable
<br /> materials therein belonging thereto, and to erect, construct, maintain, use and operate
<br /> thereon and therein buildings, structures, machinery, and equipment used in connection
<br /> with the extraction, processing and sale of sand and gravel and other salable products
<br /> associated therewith.
<br /> 6.2 Conduct of Operations. Lessee will cause all operations under this Lease to be
<br /> r carried on in a commercially reasonable manner and in accordance with all applicable
<br /> federal, state and local regulations, permits, and the terms and conditions of any bond
<br /> issued relative to such operations. Materials shall be removed from each excavation to the
<br /> point commercially feasible, through the use of equipment selected by the Lessee.
<br /> 6.3 Liens/Indemnity. Lessee shall keep the Property free and clear of liens for labor
<br /> done or work performed under this Lease, and shall keep the Property free from all other
<br /> forms of encumbrance, and will hold Lessor harmless from all claims, demands, suits,
<br /> liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees)
<br /> which may arise by reason of injury to any person employed by Lessee on the Property, or
<br /> which may arise by reason of injury to any persons or damage to any property as a result of
<br /> any operations of Lessee.
<br /> 6.4 Surrender of Possession. In the event of a valid termination of this lease, Lessee
<br /> will surrender to Lessor peaceable possession of the Property, subject to Lessee's right to
<br /> leave equipment and Materials on the Property and have access to remove such equipment
<br /> and Materials. Co-incident with such surrender, Lessee shall deliver to Lessor a release of
<br /> all its interest in this Lease. Lessee shall have 120 days to remove all of Lessee's
<br /> equipment from the Property, plus an extension of time, at no charge, for any snow or mud
<br /> conditions which cause such equipment removal to be impossible or impractical. Lessee
<br /> shall offer to sell to Lessor, at a price to be negotiated, any of Lessee's processed Material
<br /> which is stockpiled on the propetty. If no agreement can be reached, Lessee shall have 12
<br /> months to remove all of Lessee's processed Material from the Property, plus an extension
