Elk Creek Mine (C-1981-022) MT-8 <br /> ii. The area must be graded to the approved post-mining topography, as shown on Map <br /> 2.05-M6 <br /> iii. When it can be demonstrated that the disturbed area is supporting its approved post- <br /> mining land use, a Phase I, II and III bond release application should be submitted. <br /> (Note that facilities still in use for any activity related to Mining and Reclamation will <br /> not be eligible for bond release —so, assuming that OMLLC staff continue to operate <br /> from the office and support facilities on site, those facilities will not be eligible until <br /> reclamation of the entire permit area is complete and a final bond release and <br /> termination of jurisdiction application is submitted) <br /> (f) Sanborn Creek Mine Facilities (Page 2.05-60) <br /> The Sanborn Creek Mine portal area and the Sanborn Creek Fan-site & Substation No. 3 area <br /> (also referred to as the Sanborn Utility Area) received Phase III bond release with SL-4. <br /> The Sanborn Creek Mine overland conveyor and associated road have been reclaimed, but <br /> have not been included in any bond release application to date, so will continue to be <br /> included in the RCE. <br /> Two culverts under the railroad are approved as permanent structures. <br /> De-gasification wells (and associated roads) CBM-1 through -14 achieved Phase I bond <br /> release with SL-2 and Phase II bond release with SL-3. A task associated with revegetating <br /> this disturbance will continue to be included in the RCE until Phase III bond release is <br /> achieved. <br /> Fire control and monitoring boreholes in A-gulch and C-gulch achieved Phase I and II bond <br /> release with SL-2. A task associated with revegetating this disturbance will continue to be <br /> included in the RCE until Phase III bond release is achieved. <br /> (g) Elk Creek Mine Facilities (Page 2.05-62) <br /> According to sections 2.05.4 and 2.05.5 of the PAP, the post-mining land use for this area is <br /> "Undeveloped lands", with no facilities approved as permanent. <br /> Similarly to item e, above, revisions made to other parts of the PAP (Exhibit 2.05-E5, Map <br /> 2.05-M6, and Map 2.05-M8) with TR-76 have introduced some conflicting information: <br /> • Exhibit 2.05-E5, Item 6 states that five areas, some of which are in the "Elk Creek Mine <br /> Facilities" area, will support an alternative post-mining land use (presumably <br /> "Industrial/Commercial", although it is not specified), including: <br /> Page 16 of 22 <br />
