Elk Creek Mine (C-1981-022) MT-8 <br /> Elk Creek coal mine methane project(former upper fan and utility bench), access <br /> roads and powerlines (i.e. Access to North Fork Energy, LLC(NFELLC) methane <br /> project, also see Exhibit 2.03-E4 for COGCC Borehole, Elk Creek Fan Borehole#1)). <br /> Former compressor building shells, D2B sump water transfer borehole, and water <br /> tank to remain. 2.9 acres <br /> • Map 2.05-M8, Sheets 1 and 2, shows the parcel referred to above as having a post- <br /> mining land use of Industrial/Mining. <br /> • Map 2.05-M6, Sheet 3 of 6, shows the retention of the following permanent facilities: <br /> o Two buildings, previously used for compressors <br /> o Water tank <br /> o Active methane drainage pumps, and shelter <br /> o Inactive substation no. 4 <br /> o Culvert DB <br /> o A 170' section of the Elk Creek Culvert <br /> A portion of the Elk Creek Mine Facilities area achieved Phase I bond release with SL-1, but <br /> the polygon included in SL-1 was truncated due to discrepancies between the actual <br /> topography of the reclaimed area and that depicted on Map 2.05-M6, Sheet 3 of 6 at the <br /> south end of the upper section of the reclaimed Elk Creek channel. For the remainder of the <br /> area to be eligible for bond release: <br /> i. The inconsistencies in the PAP must be addressed. Sections 2.05.4 and 2.05.5 of the <br /> PAP must be retained for now, but sentences should be added referring to the <br /> alternative land use described in Exhibit 2.05-E-5, and shown on Maps 2.05-M6 and <br /> 2.05-M8. The maps should show all features that are proposed to remain as <br /> permanent structures in support of the alternative land use. <br /> ii. The area must be graded to the approved post-mining topography, as shown on Map <br /> 2.05-M6. In this case it will likely be necessary to update Map 2.05-M6 with a <br /> Technical Revision. <br /> iii. When it can be demonstrated that the disturbed area is supporting its approved post- <br /> mining land use, a Phase I, II and III bond release application should be submitted. <br /> (Note that facilities still in use for any activity related to Mining and Reclamation will <br /> not be eligible for bond release —so, all mine-related equipment and materials must <br /> be removed from the area) <br /> (h) Hubbard Creek Fan-site (Page 2.05-65) <br /> The reclamation of this area was completed in 2011. The area received Phase I and II bond <br /> release with SL-2, and Phase III bond release with SL-4, with a post-mining land use of <br /> "Undeveloped lands". <br /> Page 17 of 22 <br />
