Water deliveries <br />under the pipeline extension sce~rio will Doan at the rates defined <br />in Phase 2. <br />In order to i~lement Phase 4 of the replacement plan, certain related <br />details will need to be addressed. Rights-of-way for the pipeline <br />extension will need to be secured. 'Ihe Orchani Valley Well No. 3 <br />augmentation plan will need to be amended to identify the location of <br />the new usage, and a new cell permit may need to be secured. local <br />landowners, the BLM, and the Division of Water Resources were contacted <br />with regard to the feasibility of aoca~lishing the appurtPSant water <br />replacement plan details. OJVCC, based upon these contacts, believes <br />that all aspects of the plan, if required, could be achieved in a <br />timely fashion. OJVCC will pin sue various aspects of the plan at it's <br />convenience but will remain obligated to deliver water by trucking <br />during the interim period if r~cessary. <br />Phase 5): Repair efforts will continue at the original source of the <br />Upper Cabin Spring. If water replacement needs continue beyond April <br />• 24, 2027, CnVCC will arrange prior to that time through the filing of <br />an augmentation plan to have water withdrawals fran the Orchard Valley <br />Well No. 3 augmented with a water right wholly owned by OOVCC. As an <br />example, shares currently owned in the North Fork F'ar,,,arc Ditch could <br />be utilized and dedicated to this purpose. <br />(iii) 'Ihe quantity of surface aryl groundwater both within the proposed permit <br />and adjacent area is protected from adverse affects of the proposed <br />mining through: <br />1) Location of lease lines away from stream channels; <br />2) Limitation of minim to as small a part of any watershed as <br />possible; <br />3) Continued monitoring of hydrologic features for possible adverse <br />effects; and, <br />4) Quick repair of surface arri groundwater <br />• <br />TR 93-22 Revised 03/18/93 <br />98D <br />
