Permanent features comprise the main access road and the access road to the refuse pile and a topsoil <br />stockpile (parcel 5) at No 9 portal area. <br />III. OBSERVATIONS AND FINDINGS <br />Reclamation, comprised of backfilling and grading, topsoil placement and seeding for the requested Phase <br />I SL5 reclamation parcels, occurred between 1989 and 2020 with structure demolition occurring 2006 and <br />2020. The backfilling and grading plan is designed to achieve the approved postmining land uses. The <br />approved postmining land uses for the land applicable to SL5 are rangeland/wildlife habitat, cropland <br />and pastureland and the 176.7 acre bond release block has been reclaimed as such. The Division <br />confirms that reclamation parcels have been backfilled and graded in accordance with the approved <br />postmining topography and that drainage control has been accomplished. <br />MCM verifies topsoil replacement thickness by and included topsoil depth verification for the Williams <br />Fork Bottom Lands area to the west of the Williams Fork River conducted by The Division in October of <br />2019. Although not required for Phase I bond release, DRMS systematically conducts topsoil replacement <br />depth verification during monthly inspections following topsoil placement as documented in DRMS <br />inspection reports. <br />Compliance with Approved Post Mining Topography <br />The Division evaluated the reclamation parcels to determine if the affected areas have been backfilled <br />and graded in accordance with the approved post mine topography. To evaluate the SL5 bond release <br />block for Phase I bond release, the Division compared the approved post mining topography (PMT) as <br />depicted on Map M29 in the permit application package with the measured on the ground conditions after <br />backfilling and grading collected during the November 2020 Phase I field inspection. <br />Highwalls and face ups have been reclaimed as per the reclamation plan. No rills, significant erosional <br />features or signs of instability were observed in the bond release parcels. Vegetation was well <br />establishes throughout the reclaimed parcels, with the exception of the Williams Fork bottom lands where <br />seeding took place as recently as autumn of 2019 and 2020. Large swales and depressions were not <br />observed during the inspection of the bond release parcels. The graded parcels blend into adjacent <br />regarded land or the undisturbed landscape. Each parcel drains into the ditch system discharging to a <br />sediment pond. See the Drainage Reconstruction section below for additional details. <br />Permit Number. C1981044 Page 7 of 14 <br />
