IV. PROPOSED DECISION Based on the observations above, the Division proposes to approve the request for a partial Phase I bond release for the Trapper Mine. This proposed decision will release the applicant from reclamation liability for Phase I bond release criteria for the SL21 bond release parcels; as per Table I above, totaling 298.3 acres. The current reclamation liability amount, as documented on the proposed decision form for permit revision No. 10 (PR10), is $30,003,478.68. Prior to the issuance of the final decision for PR10, the Division approved and issued Minor Revision 226 (MR226). MR226 allowed for TMI to affect 5.2 acres of land proposed to be affected with PR10. However in order to take advantage of the weather conditions prior to the onset of winter,TMI needed to affect this 5.2 acres of land prior to final approval of PR10. Since PR10 had not been issued, DRMS was required to increase the approved affected land and liability by 5.2 acres and$20,251.26.Now that PR10 is approved, essentially MR226 is moot and the affected land and liability approved with PR10 reflects the approved affected land acreage and liability amount.Therefore the liability associated with PR10 will be the basis for the liability reduction calculation associated with SL21.The Division currently holds a performance bond of$30,500,000.00.
