i) Groundwater and surface water may be encountered, but our operation will not
affect the quantity or quality of this surface or groundwater.
j) We will comply with Colorado water laws and regulations governing injury to
existing water rights by not using water in conjunction with the operation. The
goal of removing this sediment is to increase water storage capability in Paonia
Reservoir, which is beneficial to relevant water rights holders.
k) If refuse and acid or toxic materials are exposed while harvesting this sediment,
they will be handled and disposed of in a manner that will control unsightliness
and protect the drainage from pollution. This area has been studied extensively,
and acid-forming materials are not expected.
1) By avoiding using water with this operation, we will maintain the existing
hydrologic balance, prevent off-site damage, and provide for a stable
configuration of the reclaimed area.
m) Sediment may be piled for a matter of days for dewatering. The harvested
sediment deposit will not be further processed on site.
n) Primary and secondary commodities to be extracted are clay, sand, and gravel,
intended for use as feedstock for ceramic manufacturing.
o) Expected incidental products to be mined are hematite and possibly mica. These
will either be used as feedstock in ceramic manufacturing or sold to the arts and
crafts industry.
p) No explosives are to be used in conjunction with this operation.
