This illegal activity actually occurred 20 months before the DRMS actually investigated the <br /> Derr Pit for this violation. Should this have been discovered during an annual inspection report? <br /> Unfinished Business <br /> In March I noticed a Pipeline being installed under Balsam Ave. between the Loloff Pit and the <br /> Derr Pit. Water was being pumped from the south "8 th Street Irrigation Ditch" north across a <br /> field into the pipeline and filling the Loloff Pit. According to the file there was not permission <br /> from the DRMS nor from the Division of Water Resources to pump the water into the Loloff Pit. <br /> I contacted the DRMS, Director Means and the Colorado Division of Water Resources. The <br /> Division of Water Resources immediately required the Operator to complete an update to the <br /> water plan to include pumping of water into the Loloff Pit. Director Means stated that he <br /> would personally come up to the Loloff Plt in the Spring and inspect the Pipeline that was <br /> constructed without preapproval with the DRMS.The Operator was to provide a TR to cover <br /> the construction of the pipeline and the pumping of water into the unfinshed Loloff Pit. <br /> March 26th, 2020 <br /> Kelly, <br /> Thanks for the update. <br /> I agree vegetation does not need to be established prior to filling the reservoir. <br /> The Division will require any pumping infrastructure recently constructed to allow for water <br /> conveyance to be incorporated into the Reclamation Plan via a technical revision. I am planning <br /> to inspect the site this spring. We can discuss the requirement of the technical revision, if <br /> needed, during the inspection. <br /> Russ Means <br /> Minerals Program Director <br /> Division of Reclamation, Mining and Safety <br /> After reviewing the file I could not find an inspection by Director Means nor was there a TR in <br /> the file that was to be competed by the Operator. Do I need to file a complaint against the <br /> Operator of the Loloff Pit covering the pipeline that was constructed without permission from <br /> 9 <br />
