Planning staff <br /> reviewed the complaint and visited the property on Friday February 26, 2016 and determined that <br /> the operations associated with the property are not in compliance with the USR-1660 land use <br /> permit. Planning staff also spoke with Kelly Hodges, site manager and John Vasquez who were <br /> present on site to notify them of the same issues to be discussed in this letter As you are aware, <br /> the property is governed by a Special Use Permit, USR-1660 for a Mineral Resource Development <br /> Facility, including open pit mining and material processing for a mine known as the Derr Pit, in the <br /> A(Agricultural)zone district, <br /> ,Additionally, there are activities located on site that are not permitted under this current land use <br /> permit, USR-1660, these activities include the importation of a mineral resource in the form of <br /> topsoil and over burden. The material appears to be coming from a construction site located <br /> north and east from the Derr mine site. At peak hours there are 13 plus bottom dump trucks <br /> accessing the property every 20 minutes. <br /> 8 <br />
