This complaint was lost and a <br /> new complaint was filed June 5, 2020. Why was this complaint denied for the Statute of <br /> Limitations of two years?The only reason that Ms. Snow filed the complaint is that it did not <br /> appear that there was a time limit on filing a claim as listed above. <br /> Annual Inspections <br /> Was thinking that there was to be a scheduled or a required annual inspection of the Derr Pit <br /> and the Loloff Pit. The Operator had a Cease and Desist order from the Derr Pit inspection on <br /> December 2017 because of mining outside of permitted area. They were fined $42,000 but it <br /> was reduced to only $5000 if the Operator completed an Amendment to include the area that <br /> was being mined outside of the permitted area. The operator harvested over 50,000 cubic <br /> yards of top material at a value of over$500,000.The actual mining outside of the permitted <br /> area occurred in 2016. The Weld County Planning department witnessed the illegal acivity <br /> during an inspection on March 9th, 2016. The operator was importing materials from outside <br /> of the permitted area . One would think that the DRMS would have found this violation from <br /> the previous scheduled annual inspection? <br /> 7 <br />
