14. The applicant has offered to operate the Concrete Batch:Plant Facility,during tile following hours: U.
Concrete Batch Plant Facility Operations shall be permitted from 6:00 am to 6:00 pm on weekdays and from 8:00 am to M a
6:00 pm on Saturdays from March 2 to December 20. From December 21 to March I the permitted hours for Concrete a�E
Batch Plant Facility operations are from 7:00 am to 5:30 pm on weekdays and from 8:00 am to 6:00 pm on Saturdays.

CONDITIONS OF APPROVAL
1.)The applicant shall convey an easement to Clear Creek County to be located between Clear Creek and U.S. Hwy. 6 on
the subject property,as shown on Exhibit A, for the Cicar Creek County Greenway Trail.The easement location shall be
granted and depicted on Exhibit B. prior to recordation of this Resolution.
2.)Air Pollution Emission Notice(AI'F.N)
A.)A copy of the Air Pollution Emission Notice(APE\)shall be submitted to the Planning Department by December I,
2006,
B.) If die AI'EN is revised or renewed,it copy of the new APEN shall be submitted to the Planning Department within
thirty(30)days from the issuance of the revised and/or renewed APEN.
C.) If the concrete batch plant is no longer considered exempt fi-om permitting requirements by the Colorado Department
of Public Health and Environment, it copy of the Initial Approval Permit from the Colorado Department of Public Health
and Environment shall be submitted to the Planning Departnent immediately upon issuance.
D.)If the concrete batch plant is no longer considered exempt from permitting requirements by the Colorado Department
of Public Health and Environment,a copv of the Final Approval Permit from the Colorado Department of Public Health
and Environment shall be submitted to the Planning Department, within six(6)months from the issuance of the Initial
Approval Permit.
3.) Annual Reporting Requirements
A.)As per the Colorado Department of Public Health and Environment air pol-lution reporting and permitting
requirements• annual records of product throughput shall be maintained for the concrete batch plant facility, in order to
demonstrate compliance with the permit limits and requirements.
B.)Annual records of product throughput and permit limits shall be submitted by December 31"each year to the Clear
Creek County Planning Department, P.O. Box 2000,Georgetown, Colorado 80444.`fhc County may audit said reports
and may enter the property to verify anmlal product throughput records at any time, lolluwing at least ten(10)days
notice by mail to the address of record in the Clear Creek County Treasurer's Office.
C.) Any and all air pollution complaints that ensued over the annual report time period shall be documented. including
the results of these complaints,and submitted by December 31"each year to the Clear Creek County Planning

D.)Any and all air pollution notices of violation by any prevailing authority of the County or State shall be documented,
